RESOLUTION NO. 295 l)6
RESOLUTION AUTHORIZING THE EXCHANGE OF REAL PROPERTY, IDENTIFIED AS
TAX MAP KEY: (3)7-5-005:067, AND ROAD RIGHTS-OF-WAY, IDENTIFIED AS BEING
PORTIONS OF TAX MAP KEYS: (3)7-5-004:027, 034 AND 038, WITH LANIHAU
PROPERTIES, LLC, FOR THE KUAKINI HIGHWAY IMPROVEMENTS, PALANI ROAD
TO HUALALAI ROAD.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the County of Hawaii is the owner of real property identified as Tax Map
Key: (3)7-5-005:067, containing an area of 2,248 square feet, which is the site of abandoned
Sewage Pumping Station No. 4 (see Exhibit "A"); and
WHEREAS, the County of Hawaii is the owner of Area "C," identified as being a
portion of Tax Map Key: (3)7-5-004:028, containing an area of 150 square feet (see Exhibit
"B"), which, based upon the highway improvements, is a remnant no longer required by the
County; and
WHEREAS, Lanihau Properties, LLC is the owner of:
Road Reserve Lot A-I TMK: (3)7-5-004:027 (por.) 1,252 sq. ft.
Road Reserve Lot C-1 TMK: (3)7-5-004:034 (por.) 753 sq. ft.
Area "A" TMK: (3)7-5-004:028 (por.) 65 sq. ft.
Area "B" TMK: (3)7-5-004:038 (por.) 7 sq. ft.
Area "L" TMK: (3)7-5-004:038 (por.) 250 sq. ft.
(see Exhibits "B" and "C"); and
WHEREAS, as part of the Kuakini Highway Improvements, Palani Road to Hualalai
Road, Federal Aid Project No. STP-0110(1), County Job No. P-3278, the County needs to

acquire the above-mentioned road reserves and real properties from Lanihau Properties, LLC;
and
WHEREAS, Lanihau Properties, LLC has agreed to exchange the above-mentioned road
reserves and real properties for the site of Sewage Pumping Station No. 4 and Area "C"; and
WHEREAS, the exchange of real properties and road reserves, while not equal in size, is
advantageous to the County and allows for the straightening, expansion and acquisition of
encroachment areas; and
WHEREAS, Section 2-115 of the Hawaii County Code permits the exchange of real
property for private property, and Section 2-118, Hawaii County Code, allows for the disposal
of remnant parcels.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that in accordance with Section 2-115 of the Hawaii County Code, the County of
Hawaii accepts the following:
Road Reserve Lot A-l TMK: (3)7-5-004:027 (por.) 1,252 sq. ft.
Road Reserve Lot C-1 TMK: (3)7-5-004:034 (por.) 753 sq. ft.
Area "A" TMK: (3)7-5-004:028 (por.) 65 sq. ft.
Area "B" TMK: (3)7-5-004:038 (por.) 7 sq. ft.
Area "L" TMK: (3)7-5-004:038 (por.) 250 sq. ft.
(see Exhibits "B" and "C") from Lanihau Properties, LLC, in exchange for real property
identified as Tax Map Key: (3)7-5-005:067, containing an azea of 2,248 square feet, which is the
site of Sewage Pumping Station No. 4 (see Exhibit "A"), and Area "C," identified as being a
portion of Tax Map Key: (3)7-5-004:028, containing an area of 150 square feet (see
Exhibit "B").
BE IT FURTHER RESOLVED that the County Clerk shall transmit a copy of this
resolution to (1) the Mayor Harry Kim; (2) William Takaba, Director of Finance;

(3) Bruce McClure, Director of Public Works; (4); James S. Greenwell, President, Lanihau
Properties, LLC; and (5) Gerald Takase, Assistant Corporation Counsel.
