This is to aclrnowledge receipt of your annual progress report on September 15, 1998, in
compliance with Condition P of Change of Zone Ordinance No. 96-104. Thank you for
complying with this requirement.
For your information, please note correction to your letter in regards to the start construction
date which you mention as being September 2001. The ordinance requires that the applicant
start construction of the proposed development within five years from the date of receipt of
fmal plan approval, which was July 20, 1995. Therefore, construction should start by
July 20, 2000.
We also acknowledge receipt of two copies of the Limited Archaeological Data Recovery for
subject dated March 10, 1998, and letter from the Department of Land and Natural
Resources -State Historic Preservation Division providing clearance on the subject property.
Compliance with Condition G of Ordinance No. 96-104 has been met.
Your next annual progress report shall be due on or before September 19, 1999.

Subject: LURI Corporation -Annual Report Requirement
Ordinance No. 96-104LTMK: 7-8-14: 90
The most recent ordinance granted a time extension to begin construction of
a multiple family project on the subject property before September 2001. It also
required an annual report to be filed, the fast one of which was filed on September
17, 1997.
Pursuant to the annual report requirement, I would Tike to note the following
in behalf of LURI Corporation:
1. Over the past year, the final archaeological report was prepared by
the applicant's consultant, Paul Rosendhal, Inc. This report has
since been approved by the State. A copy of the State's letter
approving the report is attached for your information.
You will note that the report and the State concluded that all of the
sites have been appropriately mitigated and that no further work is
required.
2. Relative to the construction of the project, the current Asian meltdown
and its subsequent economic implications for Hawaii have affected
the development timing of this project. As such, final construction
plans have been put on hold. The applicant is still hopeful that the
construction timetable stipulated by the Ordinance will still be met.
3. Relative to the affordable housing plan, the County has since
adopted its affordable housing ordinance which superseded the
Council's Affordable Housing Resolution. Once the economic and
marketing situation improves, the applicant will finalize its plans on
this component with the County Office of Housing and Community

Development. Please be assured that the plan will be consistent with
the County's affordable housing ordinance and will be finalized prior
to issuance of a building permit for the project.

on the first drafr and now meets with our approval. As we noted in our first letter, the two sites
that were investigated (Sites 10940 and 10941) have been adequately mitigated and will thus
require no further work.
