RE: Bill No. 123, Draft 2 (An Ordinance Amending Section 25-8-5 (Kailua Urban Zone
Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the
District Classification from Multiple Family Residential (RM-1) to Resort-Hotel (V-.75)
at Puaa 15`, North Kona, Hawaii, covered by Tax Map Key 7-5-9:23.
Dear Chairman Higa:
Transmitted herewith is Bill 123, Draft 2 regarding Applicant KPC Villages, LLC Change of
Zone Application (REZ 04-033). Draft 2 reflects an amendment approved at the Second or Final
Reading of the County Council at its meeting held at the Sheraton Keauhou Bay Resort and Spa
on March 22, 2006.
The amendment deletes Condition D in its entirety and replaces it with a new Condition D. The
language to be deleted is as follows:

The new Condition D included in the attached Bill 123, Draft 2, reads as follows: 1
"D The applicant shall construct that portion of the proposed Countv road connecting
Alii Drive with Kuakini Highwav ("Village Bypass"1 that extends along the
southern portion of the property in accordance with plans approved by the

Department of Public Works. The applicant shall complete the site preparation
and gradine for the portion of the Village Bypass which runs throu hg the property
in conjunction with the site preparation work for the development, and shall
complete the paving and striping in conjunction with the pavement of the parking
for the development. A Certificate of Occupancy for the development shall not be
issued until completion of construction of the portion of the Village Bypass which
runs throu hg the property. If required by the Department of Public Works, the
completed roadway shall be dedicated to the County at no cost to the County."
