(Draft 2) RESOLUTION SUPPORTING FINANCING OF THE PLANNING, DESIGN AND CONSTRUCTION OF THE WASTE REDUCTION FACILITY IN EAST HAWAII UTILIZING THE DESIGN-BUILD-OPERATE PROCUREMENT PROCESS WHEREAS, the Council of the County of Hawaii requested that the Administration proceed as expeditiously as possible with the selection of a Waste Reduction Facility technology to replace the South Hilo Landfill which is nearing capacity; and WHEREAS, the Department of Environmental Management has been working with the Finance Department to issue a Request for Proposal for aDesign-Build-Operate Waste Reduction Facility in East Hawaii since June 2005; and WHEREAS, it is anticipated that the Waste Reduction Facility will be constructed adjacent to the South Hilo Landfill; and WHEREAS, construction of the Waste Reduction Facility would reduce the East Hawaii waste stream considerably and would produce a fractional amount of residue that must be sent to the South Hilo Landfill; and WHEREAS, the Waste Reduction Facility could be operated in conjunction with a material recovery facility to extract recyclable materials from the feedstock; and WHEREAS, the Waste Reduction Facility could be configured to produce electrical power; and WHEREAS, although the County has considered public financing for the planning, design and construction of the Waste Reduction Facility, the County may require the Design- Build-Operate contractor to provide private financing should a less proven technology be selected; and WHEREAS, although the funding method to finance the planning, design and construction of the Waste Reduction Facility technology is undetermined at this time, the Council of the County of Hawaii wishes to show its financial commitment to and support for the Waste Reduction Facility in East Hawaii. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the County Council or the Administration may bring forward, prior to final selection of the Waste Reduction Facility Design-Build-Operate contractor, a funding method to finance the planning, design and construction of the Waste Reduction Facility in East Hawaii. BE IT FUIZTIIEI~ ICES®LVED that upon review of the funding method, the County Council or the Administration may bring forward a capital improvement project funding request, should public financing be the preferred methodology to finance the planning, design and construction of the Waste Reduction Facility in East Hawaii. I$E IT FINALLY RES®LVED that should the County require private financing provided by the Waste Reduction Facility Design-Build-Operate contractor, to better manage the contractual risks of utilizing a less proven technology, the County Council or the Administration may bring forward a funding request to provide minimal funding, if needed, to assist the Design- Build-Operate contractor to move the Waste Reduction Facility project forward as expeditiously as possible.
