ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 25, THE HAWAII COUNTY CODE 1983
(2005 EDITION, AS AMENDED), RELATING TO SEWER PUMP STATION.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI'L
SECTION 1. Purpose. A sewer pump station is not specifically mentioned as a
permitted use in any of the zoning district. Such a facility is normally a necessary
function of a larger development; and therefore, should be permitted within the various
zoning districts under the category of public and private utilities.
SECTION 2. Chapter 25, article 4, section 25-4-11, Hawaii County Code 1983
(2000 Edition, as amended) is amended to read as follows:
"Section 25-4-11. Power lines, utility substations; public buildings.
(a) Communication, transmission, and power lines of public and private
utilities and governmental agencies are permitted uses within any district.
(b) Any substation used by a public or private utility for the purpose of
furnishing telephone, gas, electricity, water, sewer, radio, or television
shall be a permitted use in any district provided that the use is not
hazardous or dangerous to the surrounding area and the director has issued
plan approval For such use.
(c) Public uses, structures and buildings and community buildings are
permitted uses in any district, provided that the director has issued plan
approval for such use."
SECTION 3. New material is underscored. In printing this ordinance, the
underscoring need not be included.
SECTION 4. In the event that any portion of this ordinance is declared invalid,
such invalidity shall not affect other parts of this ordinance.
SECTION 5. This ordinance shall take effect upon its approval.
