Your Committee on Finance, to which was refereed Resolution No. 274-06, reports as follows:
Resolution No. 274-06, transmitted by Director of Finance William Takaba, via Communication No. 732,
dated February 23, 2006, authorizes the Director of Finance to negotiate a lease of real property in
Kawaihae, Tax Map Key (3) 6-1-03:10, I 1 and 14, to the Kawaihae Canoe Club.
The Stale of Hawaii Governor's Executive Order 4042, dated April 13, 2004, set aside this property
situated at Kawaihae for the County of Hawaii to use for recreational purposes. The County is ageeable
to leasing this approximately 4.670 acres to the Kawaihae Canoe Club, which will use the area for
recreational, cultural and educational purposes relating to the perpetuation and preservation of the art of
Hawaiian outrigger canoe racing and Hawaiian koa canoes within the communities of South Kohala and
Hamakua.
Pursuant to Section 2-120(a)(2), Hawaii County Code, the Council of the County of Hawaii may, by
resolution approved by a majority of its members, direct the finance director to negotiate the lease of real
property to nonprofit organizations, at such rental rates and on such terms and conditions as deemed
proper.
Also pursuant to Section 2-120(6), Hawaii County Code, such lease of real property to nonprofit
organizations may be made without notice or appraisal as required in Chapter 2, Article l9 of the Hawaii
County Code.
Your Committee heard testimony in favor to the measure.
A Member of Your Committee felt that the lease should include language prohibiting the use of alcohol
and drugs on the property.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 274-06 and
recommends its adoption.
