RELATING TO THE REGISTRATION OF LOBBYISTS, BY DELETING THE
EXEMPTION OF ATTORNEYS FROM REGISTRATION
From Hawaii County Board of Ethics Chair Reeve N. Williams, dated March 8,
2006, transmitting the above bill. During the course of its consideration of the
issues involved in lobbyist registration, the Board considered whether the
exemption is appropriate, as the State Code of Ethics does not exempt attorneys
from registering as lobbyists. Consequently, the Board voted to propose that the
Hawaii County Code be amended so that the exemption be removed, thereby
ensuring consistency with the State Code.
Comm. 785: AN ORDINANCE TO INITIATE A CHARTER AMENDMENT TO
(Bi11255) ARTICLE VI, CHAPTER 8, SECTION 6-8.4, OF THE HAWAII COUNTY
CHARTER 2000, RELATING TO THE DEPARTMENT OF PARKS AND
RECREATION, COUNTY BANDS (Removes the exempt status of County
Bandmasters and band members)
From Director of Personnel Michael R. Ben, SPHR, dated March 22, 2006,
transmitting the above bill. To ensure compliance with Civil Service exemption
laws, the Department of Civil Service conducted a review of the exempt status of
the Bandmaster and band member positions in the Hawaii County and West
Hawaii County Bands. The Department found that all positions, including the
Bandmaster, should be in Civil Service. The Corporation Counsel recommended a
Charter Amendment to remove the County Band provisions from the Charter.
Comm. 789: AN ORDINANCE TO AMEND ORDINANCE NO. OS-86, AS AMENDED, THE
(Bill 256) OPERATING BUDGET FOR THE COUNTY OF HAWAII FOR THE FISCAL
YEAR ENDING JUNE 30, 2006 (by appropriating an additional $41,246 into the
Police Department's Marijuana Eradication account)
From Finance Director William Takaba, dated March 28, 2006, transmitting the
above bill. The U.S. Department of Justice under its Domestic Cannabis
Eradication grant program (DCE/SP), is providing the above funding. The grant
funds will be used to compensate for overtime incurred during marijuana related
operations, investigations, and community meetings; to purchase equipment to
enhance safety issues during operations/investigations; to pay for helicopter service
costs; to cover travel expenses for attending training workshops and seminars; and
to assist in marijuana investigations in conjunction with the "Weed and Seed"
Program.

above bill. The County Council recently adopted Resolution No. 270-06 which
transferred the above funds for the installation of streetlights in the `Alae
Subdivision to improve and enhance visibility, safety, and security in the area.
Comm. 800: RESOLUTION CHANGING THE FUNDING SOURCE AND THE POSITION
(Res. 306-06) STATUS OF TWO (2) DEPUTY PROSECUTING ATTORNEY (TEMPORARY)
POSITIONS UNDER THE DRUG TASK FORCE GRANT PROGRAM (changes
two (2) Deputy Prosecuting Attorney positions from temporary to permanent; and
changes of funding source from the U.S. Department of Justice's Community
Orienting Policing Services Grant to the Prosecuting Attorney's Regular Salaries
and Wages Account)
From Finance Director William Takaba, dated April 6, 2006, transmitting the
above resolution. In 2003, the Office of the Prosecuting Attorney was a recipient
to an U.S. Department of Justice's Community Oriented Policing Services (COPS)
grant award, passed through the Hawaii Community Foundation (HCF) as part of
the Big Island Meth Initiative, which provided for the establishment of two Deputy
Prosecuting (Temporary) positions, one in East Hawaii and one in West Hawaii.
With the grant funding ending in May, the County plans to continue this Drug Task
Force program by funding these two positions and changing their status to
permanent.

a total estimated value of $2,500)

defibrillator will be used at La`aloa Beach Park in Kailua-Kona by Water Safety

Comm. 803: RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER
(Res. 308-06) FISCAL YEAR AND MORE THAN ONE FISCAL YEAR FORA MULTI-
YEAR LEASE OF REAL PROPERTY FOR THE MOTOR VEHICLE
REGISTRATION OFFICE IN KONA
From Finance Director William Takaba, dated March 30, 2006, transmitting the
above resolution. The Kona Motor Vehicle Registration (KMVR) section currently
shares space with the Kona Real Property Tax office at the Hanama Place Office
Building in Kailua-Kona. In order to better serve the public, the Finance
Department is proposing to lease space formerly used by the Territorial Savings
Bank in the Territorial Centre. There will be more space to accommodate a
growing staff and the public, the parking will be better, and the parking at Hanama
Place will be somewhat relieved. The proposed lease is for five years.
Comm. 807: AN ORDINANCE TO INITIATE A CHARTER AMENDMENT TO
(Bi11261) SECTION 12-2.1, CHAPTER 2, ARTICLE XII, OF THE HAWAII COUNTY
CHARTER (2000), RELATING TO IMPEACHMENT OF ELECTED OFFICERS
(raises the number of registered voters required for impeachment of an elected
officer; and provides that only voters registered in the respective council district
may bring charges for impeachment against a Councilmember)

above bill. States that due to the increase in voter population since impeachment
provisions were established in 1979, this amendment will bring equity for

(Bi11217) RELATING TO PUBLIC IMPROVEMENTS AND FINANCING THEREOF
FOR THE FISCAL YEAR JULY 1, 2005 TO JUNE 30, 2006 (by adding the
Na`alehu Park Acquisition project for $1.2 million to the Capital Budget]

above bill. Na`alehu Park is the primary recreational site in the town of Na`alehu
containing ballfields, tennis and basketball courts, a comfort station, a community
center and several smaller structures. This purchase is necessary to ensure the park
site is held in public ownership for continued public use due to the pending
dissolution of the C. Brewer and Company, from which the County has leased this
site for numerous years.

March 30, 2006, requesting re-referral of Comm. 675 (Bill 217) to the Finance
Committee, in order for the measure to be considered along with Comm. 758 and
Resolution 290-06.
Comm. 758: RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN
(Res. 290-06) AGREEMENT WITH C. BREWER AND COMPANY, LIMITED, A HAWAII
CORPORATION, FOR THE COUNTY'S PURCHASE OF THE NA`ALEHU
PARK AND COMMUNITY CENTER IDENTIFIED BY TAX MAP KEY
(3)9-5-021-023 CONSISTING OF 6.409 ACRES FOR $1,200,000 TO BE
PLACED IN AN ESCROW ACCOUNT TOWARDS THE COST OF
INSTALLING SEWER LATERAL CONNECTION IN NA`ALEHU AND
PAHALA AND ACCEPTANCE OF THE DONATION BY C. BREWER AND
COMPANY, LIMITED, OF FIVE OTHER PARCELS CONSISTING OF

resolution. States the agreement is for the acceptance of cash proceeds and land as
final compensation by C. Brewer and Company, Limited, to implement the
Na`alehu and Pahala Wastewater Sewer Systems Project, to assist in the financing
for installation of residential hook-ups to sewer lateral connections and to release
C. Brewer from any and all future liability. States further that this is a new
resolution seeking to accomplish broader goals than Resolution 108-OS (Draft 2) by
increasing the amount of cash proceeds and by adding five additional parcels of
land to the overall agreement. This resolution supersedes all drafts of Resolution
] 08-05. Legislation for implementing this Resolution includes Comm. 675
(Bill 217).

proposed Operating Budget for the Fiscal Year 2006-2007, totaling $316,076,272
in estimated revenues and appropriations (Part I-Volume I), and includes the
operations of eleven of the County's special funds as well as the general fund.
Discusses Real Property Tax, Affordable Housing, Reserves; and Other Budget
Highlights to include Improving Parks and Recreation Services, Improving Public
Safety, Speeding up Building Permits, Expediting Capital Improvement Projects,
Improving the island's environment, Expanding Mass Transit Services, and
Enabling Departments to carry out Fair Labor Standard Act requirements. Includes
tables showing budgeted expenditures for FY OS-06 and proposed expenditures for
FY 06-07; and projected revenues for FY 06-07, listing significant changes to
revenue sources. Also submitted is the Operating Budget Proposal Part I-Volume
II, which describes departments and their programs, program objectives, highlights,
program measures, expenditures and positions.

monetary contribution of $60,000 to the County of Hawaii to be used towards the
construction of the Waikoloa Emergency Evacuation Road. The total estimated
cost of this project is $180,000 with $60,000 coming from the Waikoloa Village
Association and the remainder from County funds.

month or $275 in any six-month period for the purpose of attempting to influence legislative or
administrative action by communicating or urging others to communicate with public officials."
