This is to acknowledge receipt of your annual progress report on September 2, 1997, in
compliance with Condition L of Change of Zone Ordinance No. 94-110. Thank you for
complying with this requirement.
This is to confirm as discussed between you and Susan Gagorik by telephone on
September 17, 1997, that the most recent ordinance governing this development is Change of
Zone Ordinance No. 94-110, effective September 23, 1994, and not Ordinance No. 92-17.
Any references to commence or complete wn~+ruction as mentioned in the original ordinances
have been deleted. 'Therefore there is no time requirement to commence construction.
There are new conditions, however, regarding a Solid Waste Management Plan, drainage
system and the formulation of a Recreational Plan that need to be complied with prior to the
issuance of a building permit.

Subject: Change of Zone Ordinance (No 92-17 (REZ 395)
K. Onishi, Annual Report Requirement (Condition N)

In response to the annual report submitted on October 15, 1996, your office noted
that the next annual report was due on or before September 23, 1997. This letter is thus
being submitted to fulfill said annual report requirement
The rezoning condition required that construction begin before February 15, 1999.
Final Plan Approval was issued on March 1, 1995. A time extension request to February 15,
1999 was submitted to make the time requirement consistent with the rezoning construction
deadline of February 15, 1999.
Please be informed that the applicant intends to meet the "commence construction"
deadline. Tentatively, the applicant plans to submit construction plans during the latter part
of 1998 and secure the necessary permits before the February 15, 1999 deadline. Further
progress will be noted in the next report due in September 1998.
