Your Committee on Planning, to which was referred Communication No. 743 and attached
Resolution 282-06, pertaining to developer Kaha`olino Partners, LLC, reports as follows:
Resolution No. 282-06, transmitted by Communication No. 743 from Christopher J. Yuen, Planning
Director, dated February 27, 2006 presents a Resolution Authorizing the Mayor or His Duly
Authorized Representative to Seek Approval of In Lieu Fair Share Contribution to Satisfy Condition
"K" of Ordinance No. 02 62.
As required by Article 30, Section 2-162.1, Hawaii County Code 1983 (Republished June 2005),
Communication No. 743 transmitted a Request for Council Action and proposed Resolution for in
lieu fair share contribution in the amount of $118,112.05 to support road and traffic improvements
relating to Ordinance No. 02 62.
The Planning Department's Request for Council Action dated February 27, 2006, transmitted with
Communication No. 743, states that Kaha`olino Partners, LLC is the landowner and developer of a
proposed thirty-five (35) lot residential subdivision in Kalaoa, North Kona, Hawaii . The developer
has requested that an in lieu credit in the amount of $118,112.05 for the cost of the connecting
roadway improvements of `Ili`ili Street and Ki`eki`e Street through its property, be applied to the
required fair share contribution towards road and traffic improvements. The amount of $118,112.05
would satisfy Condition "K 5." of Change of Zone Ordinance No. 02 62.
The construction cost for the connector road is estimated at about $],032,390.00. Upon review of
Kaha`olino Partners, LLC's estimated cost of the connecting roadway construction, the Planning
Director and the Department of Public Works concurred that the total amount of $118,112.05 for the
proposed 35 residential lots be applied as in lieu fair share contribution.
There were no statements from the public presented on this matter.
