Re: Bill 229, Draft 2
It has just come to my attention that certain portions of my proposed Bill 229, Draft 2
need to be amended,
Per Chris Yuen, Planning Department Director, it will be more beneficial to the County if
the amendment states "Building permit for a residence..." instead of "Final approval of
the subdivision request..." This change in language remains in keeping with the
concerns of the council and allows the County to collect the fair share contributions to be
utilized for the improvements to the Mamalahoa Highway-Kaloko Drive intersection in a
timely basis.
Therefore, 1 would like to amend my proposed Bill 229, Drafr 2 with the following
changes: (Bolding provided for purposes of clarity only)

residence will not be fgrar3tedl issued until improvements to the
intersection at Mamalahoa Highway and Kaloko Drive are completed,
provided that if the improvements are not completed within 24 months of
the date of adoption of this ordinance the applicant shall be allowed to
proceed with the fsubdivisier;l building permit.

The improvements may include the following:
1. Illuminate intersection at night;
2 Installation of traffic signalization devices;
3 Channelize turnine movements at the intersection; and
4 Provide other safet~provements, including appropriate line of
sight distance requirements, as may be required by the State
Department of Transportation.
2. Re-letter Subsequent Conditions "K" to "N" to "L" to "O"
