SUBJECT: Charter Amendment- Impeachment of Elected Officers
This memo transmits a bill proposing a charter amendment to section 12-2.1, chapter 2, article
XII, of the Hawaii County Charter (2000), relating to impeachment of elected officers.
I write to ask the Council's favorable action in approving the proposed amendment for submittal
to the voters of our County at the 2006 general election.
The purpose of the proposed charter amendment is to:
1) Raise the low threshold of registered voters required to bring the significant charges for
impeachment against an elected officer or officer appointed to a vacancy in any elected
office; and
2) Provide that only those voters registered in the council district of a respective council
member may bring charges to the circuit court when impeaching a district council member.
These changes have been long overdue ever since the nine single-member voting districts were
established by voters in 1990, and given the increase in voter population since impeachment
provisions were established by voters in 1979. This amendment is proposed in the spirit of
equity for the constituents of our nine council districts as well as the elected officers who
represent them.
