Please be informed that the applicant currently has 3 units for the 3 existing lots of record and has a water commitment for 54 additional units. All units are equivalent to an average of 400 gallons per day, per unit. Therefore, a total of 57 units of water is available for the proposed development with the conditions stated in our June 22, 2005, letter approving the applicant's request for a water commitment time extension. A copy is enclosed for your reference. As stated in the letter, the water commitment time extension is granted until May 31, 2006. However, based upon information provided by the applicant to the Department, the development requires a total of 85 units of water, that is subject to change with water demand calculations. Hence, to acquire the necessary 28 additional units for the proposed development, extensive offsite improvements and source development are required. We are enclosing Receipt No. 244880 for your files. Pursuant to Rule 5 of the Department's Rules and Regulations, a water commitment time extension for the proposed development in the amount of 32,400 gallons per day, or 54 additional units of water at 600 gallons per day, per unit, is hereby granted until May 31, 2006. For your information, the subject property is not within the pressure service limits of the existing 12-inch waterline within Henry Street, or the 16-inch waterline within Palani Road, which are serviced from Palani Tank No. 2. Therefore, the nearest point of adequacy is at a point on the existing 12-inch waterline along Palani Road serviced from Palani Tank No. 3 with the following conditions: 1. Construct necessary off-site water improvements, which is the extension of a minimum 12-inch diameter waterline from the existing waterline along Palani Road to the property with a. connection point and distance to the property to be determined. 2. Construct necessary on-site water system improvements, which shall include, but not be limited to, the following: a. water mains capable of delivering water at adequate pressure and volume under peak-flow and fire-flow conditions; minimum diameter of mains shall be 12 inches, b. construction of an on-site minimum sized 0.10-M.G. concrete reservoir with an overflow elevation of 590 feet, W c6tor brings procgre63... Wheelock Page 2 June 22, 2005 c. installation of a pressure reducing valve unit located at an elevation and "outlet downstream pressure setting" matching the existing pressure reducing unit on Cross Roads Henry Street extension, d. service laterals that will accommodate an appropriately sized meter to each lot, e. subject to other agencies' requirements to construct improvements within the road right-of-way fronting the property affected by the proposed development, the applicant shall be responsible for the relocation and adjustment of the Department's affected water system facilities, should they be necessary, and f. fire hydrants spaced no more than 300 feet apart. Submit installation plans prepared by a professional engineer, registered in the State of Hawaii, for review and approval. 3. Remit the prevailing facilities charge balance and capital assessment fee, which are subject to change, of $268,170.00 and $27,000.00, respectively, as shown below: FACILITIES CHARGE (FC): 3 existing lots (no service) @ $1,190.00/lot $ 3,570.00 54 additional units (cry $5,500 00/unit 297,000.00 Total FC $300,570.00 WATER COMMITMENT DEPOSIT CREDIT: 54 additional units @ $150.00/unit, times 4 payments - 32,400.00 FC Balance $268,170.00 CAPITAL ASSESSMENT FEE: 54 additional units (1a $500.00/unit $ 27,000.00 Total $295,170.00 This is due and payable upon completion of the installation of the required water system improvements and prior to final subdivision approval being granted. For your information, water commitment deposits are credited towards the final facilities charge requirement for the development. Note that the amount of water commitment deposit may exceed the prevailing facilities charge; for example, when requests for time extensions continue and are approved. Until the development is finally completed, these are separate and unrelated items. In the event that water commitment deposits exceed the facilities charge, no refunds are applicable. 4. Submit the appropriate documents, properly prepared and executed, to convey the water system improvements and necessary easements to the Water Board of the County of Hawaii prior to Mr. Richard A. Wheelock • Page 3 June 22, 2005 final subdivision approval being granted. A registered land surveyor shall stamp and certify the metes and bounds description within the conveyance documents. However, prior to water meter services being granted to the development, or any lots within, the conveyance documents shall be accepted by the Water Board. 5. Comply with all other applicable policies and requirements of the Department's Rules and Regulations. Noncompliance may be cause for voiding this water commitment, at which time availability will be subject to change in accordance with prevailing water system conditions, policies, and Rules and Regulations.
