Dear Mr.Higa, I attended the hearing today on Bill 251, Kona Coffee Estates. The number of petitions and letters sent to you by fax was stated as 38 homeowners, you stated that this was a significant number of homeowners going against the development. I would like to correct that number for the record. There are 121 homes in Malulani Gardens 40 plus are owned by people that live on the Mainland or Japan. I collected and have copies of petitions and written comments from 59 homes that included signatures of some couples that came to 95 signatures plus 21 individual letters. These numbers do not include the individuals that mailed or faxed petitions and letters directly to your office. Mr. Carr wants to give the impression that he does not understand why we are upset. The last meeting we had, we had 48 hours notice, what sort of turn out did he expect? We have dealt with secret deals between Brian Cook the Developer of Malulani Gardens and Mr.R Wheelock in the past much to the detriment of the home owners. One of the persons giving testimony today had quite a few negative comments about the dealings of Mr. R Wheelock, his credibility is to be questioned. Mahalo, Adele DeCuyper Comm. No. 13r.A 1. Ref. Dear Council Members, It appears very clear that the residents of Malulani Gardens are opposed to the rezoning of this land. In my hand are copies of petitions, comments and letters that have been forwarded to you in opposition to this development. These are letters of real concern from the residents of Malulani Gardens about infrastructure, safety, roads, traffic congestion, ingress and egress. This huge cull de sac needs a road mauka or rezoning should be voted down. There are absentee owners that are not included in this petition due to time constraints. I would also like to mention The Kona Community Development Plan, currently being developed at a cost of $500,000 for the planning of all future development in Kailua- Kona area. Why are approvals for new subdivisions being discussed at this time when the plan is not complete? We know from past experience that once rezoning is granted, the applicant is able to construct a facility for any use that is allowed within the designated zone. We have Lowe's as a result, instead of a boutique shopping center called Mohala Village that stepped up the hill and fitted with the environment already created. The consequences are now apparent, we have a fifty foot cliff blasted out of the mountain, a fifty foot wall known as the Great Wall of Kona. The cliff has obliterated any mauka access for future development. Water is another barrier to this development. The only hook up available is the one used by Malulani Gardens and Lowe's complex. Kona Coffee Estates will require a water reservoir 150 feet of elevation above the highest home to have the desired pressure of 65psi. The homes at the top of Malulani Gardens complain about low pressure of 45psi Mahalo, Adele DeCuyper
