RE: Howard Robert Hofelich vs. State of Hawaii, et al.,
Civil No. 05 CV 1178 IEG (JMA)
Request for Executive Session
Pursuant to Section 92-5(a)(4), Hawaii Revised Statutes, as amended (hereinafter
"HRS"), we request attorney-client confidential discussion in executive session to consult
with the County Council on questions and issues pertaining to its powers, duties,
privileges, immunities and liabilities regarding the above-entitled matter. We ask that
this case be placed on the Council's agenda for the June 5, 2006 meeting being held in
Hilo, Hawaii.
We additionally ask the following descriptive verbiage be included in the
Council's agenda under the topic heading:
The purpose of the executive meeting is to discuss the Corporation Counsel's
interpretation, work product, and recommendations concerning the litigation in
this case, including the hiring of special counsel, which necessarily involve
discussion concerning the Council's powers, duties, privileges, immunities, and
liabilities thereto. This meeting is closed to the public pursuant to Section 92-
5(a)(4), Hawaii Revised Statutes, as amended.
