No. 817/Bill No. 266 PLACE: Council Chambers TIME: 10:00 a.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Communication No. 817 and Bill No. 266, transmitted by Mayor Harry Kim, dated Apri14, 2006, regarding a Change of Zone request by Sonny Ventures, LLC at Kalaoa 5`h, North Kona, Hawaii, TMK: 7-3-61:1-10,17,18,20-22; pors of 11,12,19,24-26,50,53 & 54 reports as follows: Bill No. 266 seeks to amend Section 25-8-3 (North Kona Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification of approximately 6.643 acres of land within the Lokahi Mauka Subdivision from Neighborhood Commercial 10,000 squaze feet (CN-10) to Single-Family Residential 10,000 squaze feet (RS- 10). Communication No. 817 reports the Hawaii County Planning Commission, as required by the Hawaii County Charter, Chapter 4, Section 6-4.3(C), considered the above request and accompanying Bill No. 266 on March 24, 2006. The Commission concurred with the Planning Director's favorable recommendation for approval of this matter. Communication No. 817 transmits the following findings and recommendations: The original rezoning of this property was approved in 1990. At that time the developer planned a 125+ acre subdivision on the site, the Pu`uhonua Subdivision, to include approximately 600 multiple and single-family residential units plus a neighborhood commercial area. In 2003, a Planned Unit Development (PUD) permit was granted for the property and the concept for the residential subdivision changed. The current subdivision is call Lokahi, consisting entirely of single-family residences, with a total of 184 residences being developed in five phases. Phases 1 and 2 have been built and the subject property falls within Phase 2 of the Lokahi Mauka Subdivision. All of the land within Phase 2 has been subdivided and most of the lots have been sold. The purpose of this zoning amendment is to eliminate the neighborhood commercial zoning area (6.643 acres) and rezone it to asingle-family residential district: a designation which matches the actual use of the property. Bill No. 266 will make the zoning designation of the property consistent with the existing and intended residential use of the property. The subject property is located in the Lokahi Mauka Subdivision located mauka of Queen Ka`ahumanu Highway, south of the makai portion of the Kona Palisades Subdivision. There are multiple accesses to the subdivision from Kaiminani Drive, some of which are completed and some of which are under construction. PC REPORT NO. 68 Communication 817 Bill 266 Page 2 of 3 The approval of the Change of Zone request from the Neighborhood Commercial 10,000 squaze feet (CN-10) to the Single-Family Residential 10,000 square feet (RS-10) zoned district would result in an appropriate land use pattern that will further benefit the public based on the following: The proposed change of zone is in alignment with the Land Use element of the General Plan, which states that the County shall "allocate appropriate requested zoning in accordance with the existing or projected needs of neighborhood, community, region and County." Although this portion of the subdivision is zoned Neighborhood Commercial, single-family dwellings have been constructed on the majority of the lots. The requested "down-zoning" more accurately reflects the existing character of the neighborhood. Surrounding properties include single-family residences, as well as vacant lands to the south and to the west. The proposed change of zone complements surrounding land uses in the area. All essential services and utilities are available to the project site. The Federal Emergency Management Agency Flood Insurance Map (FIRM) identifies the site as "X" or outside the 500-year flood plain. The request will have no impact on traditional, customary Hawaiian rights or resources, nor will it impact access to the mountains or the shoreline. The proposed action will not result in any additional development of this portion of the Lokahi Subdivision. Requisite of the Planning Director's favorable recommendation for the Change of Zone request aze four conditions contained in Bill No. 266 that outline specific requirements for the proposed project, including a restriction on the construction of a second dwelling unit to be recorded in the deed of each lot within the subject area. At the May 1, 2006 Committee on Planning meeting no public testimony was received regarding this matter. Your committee concurs with the Planning Commission's and the Planning Director's favorable recommendation for approval of the Change of Zone request.
