Your Committee on Public Works and Intergovernmental Relations, to which was referred
Resolution No. 309-06, reports as follows:
Resolution No.3091-06, transmitted by Assistant Corporation Counsel Gerald Takase via
Communication No. 804, dated Apri13, 2006, authorizes dedication of Road Lot 51 (Eleele
Street), Lot 52 (Haena Street) and Lot 53 (Haena Street) in Kilohana Kai at Waikoloa, Phase 1,
from Cleazly Waikoloa Limited Liability Company.
Clearly Waikoloa Limited Liability Company has constructed all subdivision improvements and
received subdivision approval, and is desirous of dedicating the subject roadways, including all
subdivision improvements thereon, to the County of Hawaii for road and drainage purposes.
Section 23-10 of the Hawaii County Code prohibits the council from receiving by dedication any
streets in any subdivision platted after December 2, 1966, except upon full compliance with the
provisions of Chapter 23 of the Hawaii County Code. The subdivision improvements have been
inspected and approved by the County of Hawaii Depaztment of Public Works and the Planning
Department. The subdivision improvements aze in acceptable condition for dedication, and aze in
full compliance with the provision of Chapter 23, Hawaii County Code.
Article XIII, § 13-12 of the Hawaii County Charter provides that the Council may accept gifts
which include the dedication of land on behalf of the County of Hawaii.
There was no testimony from members of the public regarding the proposed acceptance. There
was no discussion from members of your Committee.
Your Committee on Public Works and Intergovernmental Relations is in accord with the purpose
and intent of Resolution No. 309-06 and recommends its adoption.
