Re: C-939/RESOLUTION 383-06/PG99 tv or ~U-^ COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 3133 X06 RESOLUTION TO INITIATE INTERIM AMENDMENTS TO THE GENERAL PLAN FOR LANDS ADJOINING HONOKOHAU HARBOR AT KEALAKEHE, DISTRICT OF NORTH KONA, COUNTY OF HAWAII. WHEREAS, the purpose of the County of Hawaii General Plan is to guide the pattern of future development in Hawaii County based on long-term goals; and WHEREAS, Section 16.2, Interim Amendments, of the General Plan, provides, in pertinent part, as follows: "(1) The County Council may initiate amendments to the General Plan at any time other than during the comprehensive review pursuant to the following procedures: (a) The County Council may, by resolution, direct the Planning Director to conduct a study to determine the feasibility of a proposed amendment...."; and WHEREAS, there are approximately 290 acres of land owned by the State of Hawaii ("State parcel") adjacent to the Honokohau Small Boat Hazbor ("HSBH") that have been identified for future expansion of the hazbor basin in connection with the existing hazbor; and WHEREAS, there are approximately 200 acres of land adjacent to HSBH that are owned by the State of Hawaii, Department of Hawaiian Homes Lands ("DHHL"), which land is the primary DHHL land in North Kona with significant income-generating potential to support DHHL housing programs ("DHHL parcel"); and WHEREAS, in February 2004, DHHL leased the DHHL parcel to Jacoby Development, Inc., for expansion of harbor facilities and development of a mixed-use (commercial, light industrial, retail/restaurant, hotel and other transient accommodations) project referred to as "Kona Kai Ola"; and WHEREAS, in November 2005, the State of Hawaii, Board of Land and Natural Resources ("BLNR") entered into a development agreement with Jacoby Development, Inc., relating to the State pazcel for expansion of HSBH and development of the Kona Kai Ola project; and WHEREAS, under the 1989 General Plan, the Land Use Planning Allocation Guide ("LUPAG") Map designated the aforementioned lands as Urban Expansion, Resort, and Open areas; and WHEREAS, in Februazy 2005, the General Plan and LUPAG designations were amended, deleting the Resort designation for the DHHL parcel and the Urban Expansion and Resort designations for the State parcel, although the County was aware of the existing DHHL lease and pending BLNR agreement for development of the Kona Kai Ola project at HSBH; and WHEREAS, the State of Hawaii, Department of Land & Natural Resources and the DHHL continue to support the development of these lands to expand HSBH and its related commercial, light industrial, resort, and recreational uses; and WHEREAS, development of the Kona Kai Ola project will facilitate expansion of infrastructure, public utilities, and public facilities within the Keahole to Kailua-Kona sub- region; and WHEREAS, the feasible development of these lands requires amixed-use development utilizing LUPAG map designations including, but not limited to, Urban Expansion, Resort, and Open areas. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that, in accordance with Section 16.2 of the County of Hawaii General Plan, the Council hereby initiates the following interim amendments to the General Plan, and the Planning Director is directed to conduct a study to determine the feasibility of amending the General Plan as follows: 1. Section 14.7.5.7.1, Profile, North Kona, of the General Plan shall be amended to include the following: "The State Department of Hawaiian Home Lands and the State Department of Land and Natural Resources own lands adjacent to the Honokohau Small Boat Hazbor. These agencies have entered into agreements for the development of their respective lands, including the future expansion of existing harbor facilities, commercial, light industrial, hotel and other transient accommodations, recreational facilities, and open space uses. Certain amenities are essential to encourage and facilitate more intensive commercial and recreational use of the hazbor and allow charter boat clientele to secure overnight accommodations in the immediate vicinity." 2 2. Section 14.7.5.7.2, Courses of Action, North Kona, of the General Plan shall be amended to include the following: "(d) Support the expansion of the Honokohau Small Boat Harbor and a mixed use development of adjoining lands with commercial, light industrial, hotel and other transient accommodations, recreational facilities, and open space uses." 3. Pursuant to and consistent with the map attached hereto as "Exhibit A", the General Plan Land Use Pattern Allocation Guide map shall be amended to include Open, Resort, and Urban Expansion area designations within the lands situate at and adjacent to the Honokohau Small Boat Harbor that aze owned by the State Department of Hawaiian Home Lands and the State Department of Land and Natural Resources. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmit certified copies of this resolution to Mayor Hazry Kim; Mr. Christopher J. Yuen, Planning Director; and Mr. C.
