RESOLUTION NO.
A RESOLUTION ACCEPTING THE DONATION OF A RIGHT-OF-WAY, BEING A
PORTION OF TAX MAP KEY: (3)2-4-012:030, SITUATE AT WAIAKEA, COUNTY AND
STATE OF HAWAII, FROM YOSHIMI NAKAYAMA AND AIKO NAKAYAMA, FOR
THE SOUTH HILO ROADSIDE IMPROVEMENTS PROJECT.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, YOSHIMI NAKAYAMA and AIKO NAKAYAMA are the owners of real
property situate at Waiakea, Hawaii, being Parcel 8, containing an area of 1,198 square feet, and
identified as being a portion of Tax Map Key: (3)2-4-012:030 (see attached); and
WHEREAS, the County will be doing roadside safety improvements along Komohana
Street in South Hilo, County and State of Hawaii, and must acquire real property for this public
purpose; and
WHEREAS, the above -referenced property presently owned by the Nakayamas is an
essential part of the South Hilo Roadside Improvements Project; and
WHEREAS, the Nakayamas have expressed a desire to convey and gift the aforesaid
right-of-way to the County of Hawaii, in fee simple, free of charge; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter (2000) provides
that the Council, on behalf of the County of Hawaii, may accept gifts or donations of real
property.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that in accordance with Article XIII, Section 13-12 of the Hawaii County Charter
(2000), the County of Hawai `i is hereby authorized to accept the donation of Parcel 8, containing
an area of 1,198 square feet, identified as being a portion of Tax Map Key: (3)2-4-012:030,
situate at Waiakea, County and State of Hawaii, and delineated on the attached map, from
Yoshimi Nakayama and Aiko Nakayama, in fee simple, free of charge, for the South Hilo
Roadside Improvements Project.
BE IT FURTHER RESOLVED that a letter of appreciation be sent to Yoshimi
Nakayama and Aiko Nakayama.
BE IT FINALLY RESOLVED that the Clerk of the County of Hawaii is directed to
transmit copies of this resolution to (1) the Honorable Harry Kim, Mayor of the County of
Hawaii; (2) the Department of Public Works; (3) Assistant Corporation Counsel Gerald Takase;
and (4) Yoshimi Nakayama and Aiko Nakayama, 1219 Komohana Street, Hilo, Hawaii 96720.
