Request for Executive Session
Pursuant to Section 92-5(a)(4), Hawaii Revised Statutes, as amended
(hereinafter "HRS"), the Office of the Corporation Counsel respectfully requests
the above matter be agendized at the meeting of the Hawaii County Council on
Wednesday, June 21, 2006, for confidential attorney-client discussion.
We make this request as we anticipate discussion on questions and
issues pertaining to the Hawaii County Council's powers, duties, privileges,
immunities, and liabilities.
The discussion will cover the County's involvement in pending litigation in
the above case, including but not limited to the payment of special counsel fees
and costs.
My attorney work product as well as the attorney work product of attorneys
working in our office and on the County's behalf may be produced in advance of
the meeting under confidential cover, and may be discussed at this executive
meeting.

We ask the following descriptive verbiage be included in the Council's
agenda under the topic heading:
The purpose of the executive meeting is to discuss the Corporation
Counsel's interpretation, work product, and recommendations concerning
the litigation in this case, including but not limited to the payment of
special counsel fees and costs, which necessarily involve discussion
concerning the Council's powers, duties, privileges, immunities, and
liabilities thereto. This meeting is closed to the public pursuant to Section
92-5(a)(4), Hawaii Revised Statutes, as amended.
