Re: Operating Budget
The Young Men's Christian Association (YMCA) of Honolulu, through the State Attorney General's
Office, has received funds through the State Legislature Act 40, Session Laws of Hawaii 2004,
designated for the Pahoa Weed and Seed Program. Earlier, the YMCA awarded $33,500 to the
Hawai'i County Police Department to fund law enforcement services in the Pahoa Weed and Seed
area. The YMCA is amending the award with an additional $15,000 of "buy money" to use to
purchase illicit drugs as part of its undercover covert operations in meeting the objectives of this
Pahoa Weed and Seed grant.
Enclosed is a bill for an ordinance amending the Operating Budget by appropriating this additional
$15,000 award.

To appropriate an additional $15,000.00 under the "Act 40 Funds" account number 010.201.5216.20.115.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The Young Men's Christian Association is providing an Agreement for Provision of Services from Act 40
Grant funds they have received from the State Department of the Attorney General. These funds will
address the prevention of occurrrences or reoccurrences of domestic violence, substance abuse, and
juvenile delinquency. The department is receiving these additional funds for buy money to assist with the
objectives in the grant.

AMENDMENT NO. 1 TO AGREEMENT FOR PROVISION OF SERVICES
DATED April 20, 2006
THIS AMENDMENT NO. 1 TO AGREEMENT FOR PROVISION OF
SERVICES DATED April 20, 2006, is made this day of 2006,
by and between the YOUNG MEN'S CHRISTIAN ASSOCIATION ("YMCA'), whose
business address is 1441 Pali Highway, Honolulu, HI 96813 and the COUNTY OF
HAWAII, a municipal corporation of the State of Hawaii with its principal place of
business at 25 Aupuni Street, Hilo, Hawaii (hereinafter "County").
WITNISSETH:
WHEREAS, on April 20, 2006, County and YMCA fully executed and entered
into a Agreement for Provision of Services ("APS") related to law enforcement in the
Pahoa Weed & Seed Act 40 Proposal, establishing that the Hawaii County Police
Department would use $33,500.00 (THIRTY-THREE THOUSAND-FIVE HUNDRED
DOLLARS AND NO CENTS) in grant money from the YMCA to fund law enforcement
services in the Pahoa Weed & Seed area for the period of January 1, 2005 up to and
including December 31, 2006.
WHEREAS, the April 20, 2006, APS inadvertently omitted an additional
$15,000.00 (FIFTEEN-THOUSAND DOLLARS AND NO CENTS) of "buy money"
from the YMCA that the Hawaii County Police Department would use to purchase illicit
drugs as part of its undercover covert operations in meeting the objectives of this Pahoa
Weed & Seed grant.
WHEREAS, the parties wish to amend the terms of the APS by changing the
grant amount from $33,500 (THIRTY-THREE THOUSAND FIVE-HUNDRED
DOLLARS AND NO CENTS) to $48,500.00(FORTY-EIGHT THOUSAND FIVE-
HUNDRED DOLLARS AND NO CENTS) due to the omission of the additional $15,000
(FIFTEEN THOUSAND DOLLARS AND NO CENTS) in the April 20, 2006, APS.
NOW, THEREFORE, IT IS AGREED THAT THE AGREEMENT FOR
PROVISION OF SERVICES DATED April 20, 2006, AS DESCRIBED ABOVE IS
HEREBY AMENDED AS FOLLOWS:
1. The portion of the APS entitled "SECTION TWO" setting forth the
SCOPE OF WORK and related funding shall be amended to read as
follows:
"The COUNTY OF HAWAII agrees to supply such services as are
necessary for the prompt and efficient delivery of services as required
under the APS. The COUNTY OF HAWAII hereby agrees to perform
and supply the following minimum and/or mandatory tasks,
responsibilities, and services to the Pahoa Weed & Seed site.
- Purchase law enforcement equipment:
- Night vision monocular for police officers
(1 @ $900)
- Portable screen (2 @ $300 = $600)
- Laptop computers for police officers and
prosecutors (4 @ $1,875 = $7,500)
- Surveillance cameras and support equipment
($7,500)
Total Law Enforcement Equipment $16,500
- Utilize funds designated for law enforcement as noted in the
approved attached proposal:
Police Overtime ($40/hour x 250 hours = $10,000)
Community Policing/School Resource Officer
overtime ($35/hour x 100 hours x 2 = $7,000)
Total Overtime $17,000
- Buy Money (CORRECT AND AMEND) $15,000
TOTAL $48,500"
IT IS FURTHER UNDERSTOOD AND AGREED THAT this AMENDMENT
NO. 1 is supplemental to the AGREEMENT FOR PROVISION OF SERVICES DATED
April 20, 2006, and all terms, conditions, recitations, provisions and covenants contained
in the AGREEMENT FOR PROVISION OF SERVICES DATED April 20, 2006, unless
specifically modified, altered, and changed herein, continue to remain in full force and
effect as of the date first written in the APS.
IN WITNESS WHEREOF, the parties hereto have caused this instrument to be
duly executed as of the day and year first above written.
