Re: A Bill For An Ordinance To Initiate A Charter Amendment To Article VI, Chapter 4, Section
6-4.3, Hawaii County Charter (2000) Relating to Bifurcating the Planning Commission into an
East Hawaii Planning Commission and a West Hawaii Planning Commission.
Dear Chairman Higa and Council Members:
Transmitted herewith is a proposed Ordinance calling for a Charter amendment and a request for the
Council's favorable action in approving the proposal for submittal to the voters of Hawaii County.
The purpose of the attached Bill For An Ordinance is to amend "Article VI, Chapter 4, Section 6-4.3.
Planning Commission." of the Hawaii County Charter (2000) and bifurcate the Planning Commission
into an East Hawaii Planning Commission and a West Hawaii Planning Commission.
The attached bill would amend Article VI, Chapter 4, Section 64.3 of the Hawaii County Charter (2000)
to read as follows:
"Section 6-4.3. Planning Commission. The planning commission shall consist of nine
members, one from each council district, who shall be appointed by the mayor and
confirmed by the council in the manner prescribed in section 13-4. The nine member
planning commission shall be divided into an East Hawaii Planning Commission and a
West Hawaii Planning Commission Council Districts 1 2 3. 4 and 5 shall comprise the
East Hawaii Planning Commission and Council Districts 6. 7. 8 and 9 shall comprise
the West Hawaii Planning Commission. Each member shall be a legal resident and
registered voter of the district [whiehl that the member represents...."
The material to be repealed is bracketed and stricken and the new material is underscored.
The subject matter of this ordinance concerns the Planning Commission and its duty to review and make
recommendations regarding planning issues. As stated in Rule No. 7 2.(b), Council Rules of Procedure,

these matters fall within the scope and responsibilities of the Committee on Planning. Accordingly, also
enclosed is a letter from the Chair of the Planning Committee requesting that this matter be waived from
the Planning Committee to the full Council for immediate action. Due to charter amendment deadlines,
timely approval of this matter is critical and is appreciated.

Pursuant to Sm--tiuu 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Planning Committee to the full Council for immediate action. In reviewing this
matter, timely approval is crucial. It is therefore advantageous that approval is granted and the
matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Planning Committee
for placement on its future agenda.

Article VI, Chapter 4. Section 6-4.3, Hawaii County Charter (2000) relating to Bifurcating
the Planning Commission into an East Hawaii Planning Commission and a West Hawaii
Planning Commission dated June 16, 2006 requesting to be waived out the Planning
Committee. Please be advised that I will not be waiving your bill regarding the Planning
Commission. With all due respect and courtesy to my fellow colleagues I strongly, feel
