L~6 9S AN ORDINANCE AMENDING ARTICLE VII, CHAPTER 4, OF THE HAWAII COUNTY CHARTER (2000), RELATING TO THE FIRE DEPARTMENT. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this amendment is to change the title of the County's fire department from "Fire Department" to "Hawai`i Fire Department." The department has been known by a number of names since its formation in the late 1880's. In 1892 the island's fire fighting unit was officially titled the "Hilo Volunteer Fire Department." Since those early days, the department and its official title have continued to evolve. This proposal would adopt the name, "Hawai`i Fire Department" as the official title of the department. SECTION 2. The title of Article VII, chapter 4, of the Hawaii County Charter (2000), relating to the Fire Department, is renamed as Follows: "CHAPTER 4 HAWAII FIRE DEPARTMENT" SECTION 3. Article VII, chapter 4, section 7-4.1, of the Hawaii County Charter (2000), is amended to read as follows: "Section 7-4.1. Organization. There shall be a Hawaii fire department consisting of a fire chief, a deputy fire chief, a fire commission and the necessary staff. The fire chief shall be the administrative head of the Hawaii fire department." SECTION 4. Article VII, chapter 4, section 7-4.2, of the Hawaii County Charter (2000), is amended to read as follows: "Section 7-4.2. Statement of Policy. It is hereby declared to be the purpose of this chapter to establish in the county a system of fire protection and prevention and emergency services which shall be based on qualified and professional leadership and personnel. In order to achieve this purpose, the Hawaii fire department shall be operated in accordance with the following: (a) Standazds for recruitment shall be designed to attract into the department persons with high degrees of education, intelligence and personal stability. (b) Promotions and other personnel actions shall be based upon fair and appropriate standards of merit, ability and work performance. (c) Appropriate training shall be provided to the maximum extent possible and practicable." SECTION 5. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 6. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 7. Upon adoption of this ordinance, this council, by appropriate resolution, shall provide that this amendment be submitted to the electorate of Hawaii County for approval at the 2006 general election. SECTION 8. The charter amendment proposed in this ordinance shall take effect upon its approval by a majority of voters in the 2006 general election.
