RE: Bill 224, Draft 7
(Amends Section 25-8-3 (North Kona Zone Map), Article 8, Chapter 25 (Zoning Code)
of the Hawaii County Code 1983 (2005 Edition), by Changing the District Classification
from Agricultural (A-3a) and Open to Project District (PD) at Kau, North Kona, Hawaii,
covered by TMK: 7-2-5:1 (approx. 725.2 acres) Hiluhilu Development, LLC,
Applicant.)
Following re-examination of the record, amendment to Bill 224, Draft 6 is being proposed to conform to
agreements reached at the June 21, 2006 Council meeting in Kona with respect to Makalei Drive.
At the June 21, 2006 meeting, representatives of the Makalei Homeowners Association, Larry Johnson
and Jerry Schneyer, the attorney for applicant, Alan Okamoto, and Council Member Pilago discussed the
wording of Condition X, subparagraph 11 that referenced Makalei Drive as an alternative mauka/makai
connector road when in fact it is a "minor" road.
Following the discussion above, and in order to protect the residents of Makalei Estates and preserve
Makalei Drive as a "minor" road, it was agreed that Condition X, subparagraph 1 1, would be amended to
identify Makalei Drive as a "minor" road and Road 4 as a "connector" road and that Makalei Drive would
not be opened to the public until the connector Road 4 was open.
Since the above agreements are not reflected in Draft 6, 1 propose the following amendment to Bill 224,
Draft 6 as follows:
Condition X, subparagraph 1 1, be amended as follows:
"1 I. Maka[k}lei Drive is a "minor road" and will not be open to the public {asaH

Additionally, to correct a typographical error, Condition X, subparagraph 1.(b) is amended as follows:
"X.
1.
(b) If a grade separated interchange is not available to connect Road "1" to Queen
Kaahumanu Highway when Applicant is ready to make the connection, Applicant
shall improved} the intersection at its expense as required by the Department of
Transportation,
The material to be repealed is bracketed and stricken and the new material is underscored.
