Dear Council Chair Higa and Council Members:
RE: Kailua Village Design Commission
Status on contacting nominees
At the request of the County Council, we have followed up with each of the
four nominees to the Kailua Village Design Commission who did not appear for
the initial confirmation hearing before the Hawaii County Council Committee on
Planning on June 20, 2006.
At the onset, I stress that many of the nominees may not have been given
sufficient advance written notice of the Planning Committee meeting. Thus, the
nominees should not be faulted for failing to appear before the Planning
Committee on June 20.
On June 23, 2006, our office sent letters and emails to the four nominees
who did not appear. We report the findings of our inquiry below.
1. Theresa L. Andreae - Ms. Andreae is interested in serving, and
regrets that she was not able to attend the June 20 meeting, and will
not be able to attend the Council meeting on July 7, as she is in
Michigan visiting relatives. She is not expected to return to Hawaii
until July 15. We recommend the Council proceed to confirm Ms.
Andreae.
2. Stephen J. Herbert - Mr. Herbert is interested in serving. Mr. Herbert
was on an extended trip, and did not receive the initial notification to

appear before the Planning Committee. He is in contact with Mr.
Bennett Mark of the Planning Department (Kona). Mr. Herbert has
indicated he will appear before the Council via videoconference if
required to do so. We recommend the Council proceed to confirm Mr.
Herbert, if you are comfortable with the information on hand.
3. Cynthia L. Hope - Ms. Hope is interested in serving. As suspected,
she did not receive her initial written notice in time to attend the
Planning Committee meeting. She will be on the mainland on July 7,
and will not be able to attend the Council meeting. We recommend the
Council proceed to confirm Ms. Hope.
4. David M. Ross - Mr. Ross is interested in serving. He expressed a
desire to "do the right thing," and appear before the Council for his
confirmation hearing on July 7. 1 advised Mr. Ross I would check with
the Council to see whether his presence is necessary. If so, I will
contact him at his office and ask that he appear before the Council via
videoconference. If the Council is comfortable with his nomination and
the information on file, we recommend Mr. Ross be confirmed.
Thank you for considering our recommendation. Our office will provide
whatever assistance the Council desires in order to move this matter forward.
