CALL TO ORDER The Executive Committee was called to order by President Dain P. Kane at 10:05 a.m. The following members present comprised a quorum County of Maui: President Dain P. EXECUTIVE COMMITTEE MEETING MINUTES The minutes of the April 21, 2006 meeting of the Executive Committee was approved. III. REPORTS OF COMMITTEES There were no committee reports. IV. UNFINISHED BUSINESS A. Proposed HSAC Budget For Fiscal Year 2006-07 OCS/062006/11:01/HM All Executive Committee members stated that their councils have approved the proposed HSAC budget for fiscal year 2006-07. The following communications were considered: 1. Correspondence, dated April 24, 2006, from the HSAC President requesting all four councils to approve the proposed HSAC budget for fiscal year 2006-07. 2. Correspondence, dated June 5, 2006, from the HSAC Treasurer regarding an increase of the 2007 NACo dues. 3. Correspondence, dated June 6, 2006, from NACo stating that an increase of WIR dues for 2007 is not expected. B. School Impact Fee Working Group President Kane noted that the School Impact Fee Working Group, formed by the Legislature, will continue its work. C. Schedule Of Upcoming HSAC Meetings President Kane indicated that the following is a tentative schedule of upcoming HSAC meetings: July 14, 2006, Friday, place and time to be announced. August 2006 No HSAC meeting. September 2006 No HSAC meeting. October 13, 2006, Friday, place and time to be announced. November 9, 2006, Thursday, place and time to be announced. December 8, 2006, Friday, place and time to be announced. Treasurer Tokioka stated that the Kauai Council would be willing to host the meeting in July. Secretary Cachola reported that he will be out of town on July 14 and cannot attend the meeting in July if held on the 14tH 2 President Kane asked the Executive Committee if there were any objections to meeting on Kauai in July. There were no objections. President Kane suggested that the July meeting continue to be tentatively scheduled for the 14th on Kauai. If the meeting date must be changed, the incoming Executive Committee members may choose to do So. He requested staff to work with Executive Committee members to select a meeting date in July acceptable to all. V. NEW BUSINESS A. Treasurer's Reports The Executive Committee approved the following Treasurer's Reports: 1. Report for March 2006 submitted by the HSAC Treasurer by correspondence, dated April 12, 2006, for the fiscal period March 1 through March 31, 2006. 2. Report for April 2006 submitted by the HSAC Treasurer by correspondence, dated June 1, 2006, for the fiscal period April 1 through April 30, 2006. B. Net Profit From 2005 HSAC Year-End Conference President Kane noted that a check of $1,526.87 from the Hawaii Council as the net profit from the 2005 HSAC Year-End Conference has been received. C. Board Of Advisors For the State Judiciary's Center For Alternative Dispute Resolution President Kane indicated that the Chief Justice of the Hawaii Supreme Court, by correspondence dated May 4, 2006, has requested HSAC to appoint a representative to the Board of Advisors for the State Judiciary's Center for Alternative Dispute Resolution. He requested the Executive Committee members to discuss the matter with their councils and submit 3 nominees who are interested in serving on the Board. The Executive Committee then will make an appointment from the nominees. Kauai Councilmember Rapozo reported that Kauai Councilmember JoAnn Yukimura already is representing HSAC as a member of the Board. Thus, he suggested that it would be appropriate for the other member to be from another county council. D. Statewide Program On Parking For Persons With Disabilities. President Kane noted that the Kauai, Hawaii, and Honolulu councils have expressed support for the Maui Council's efforts to obtain fair and adequate reimbursements for the counties' administration of the parking for persons with disabilities program. The support was expressed in the following: 1. Correspondence, dated April 13, 2006, from the Kauai County Clerk transmitting a copy of Resolution No. 2006-14 which urges the Governor and Department of Health's Disability and Communication Access Board to fairly and adequately reimburse the County of Kauai for expenses incurred for the statewide program on parking for persons with disabilities. 2. Correspondence, dated May 23, 2006, from the Hawaii County Clerk transmitting a copy of Resolution No. 357-06 which supports Maui County and Kauai County in their efforts to receive fair and adequate reimbursement for the statewide program on parking for persons with disabilities. 3. Honolulu Council Resolution 06-105 entitled, "Requesting The State To Fairly And Adequately Reimburse The Counties For Their Operation Of The Statewide Program On Parking For Persons With Disabilities." E. New HSAC Checking Account By correspondence, dated June 8, 2006, the HSAC President requested the Executive Committee to approve 4 the disbursement to the incoming Treasurer of $1,000 to initiate a new HSAC checking account. Maui staff member Richelle Kawasaki reported that the existing HSAC checking account is old and permits only three checks to be issued per month without charge of a service fee. Ms. Kawasaki explained that HSAC may be able to get better terms under a new checking account. President Kane added that now is the opportune time to change the checking account because of the change in Treasurer. Treasurer Tokioka concurred. President Kane clarified that the intent is to close the old account after the new account is opened. The Executive Committee approved the request for the $1,000 disbursement. G. County Reports There were no county reports. F. Marine Debris Cleanup Project President Kane deferred the discussion on the marine debris cleanup project until the end of calendar. H. National Association Of Counties (NACo) Report Maui Council Chair Hokama reported that a delegation from Hawaii attended the WIR Conference in May in Sacramento. He further stated that there is a contested race for NACo Vice President among four persons. The Hawaii delegation has not decided who to support or whether to support anyone. He requested the Executive Committee to consider the matter. He elaborated that, in the past, HSAC has always collectively agreed on the candidates to be supported for NACo offices. He commented that, if HSAC cannot agree, each council will have to support the candidate for its own choice. 5 Chair Hokama also reported that the incoming NACo President has said she would support the appointment of HSAC members to NACo posts. President Kane recommended that the Executive Committee members discuss with their councils what candidate to support for the NACo vice presidency and be ready to make a decision at the meeting in July. Treasurer Tokioka thanked Chair Hokama for his efforts throughout the years on NACo matters. I. Western Interstate Region (WIR) Report There was no WIR report. VI. ELECTION OF OFFICERS A. HSAC Slate Of Officers All Executive Committee members reported that their councils have approved the following slate of HSAC officers for fiscal year 2006-07: 1. President Mel Rapozo (Kauai); 2. Vice President Stacy K. Higa (Hawaii); 3. Secretary Romy M. Cachola (Honolulu); 4. Treasurer Joseph Pontanilla (Maui). The Executive Committee then formally approved the slate. Treasurer Tokioka thanked President Kane for his leadership during his presidency. Secretary Cachola thanked the other three Executive Committee members for their efforts. None of them will return to the Executive Committee in the next fiscal year. VII. ANNOUNCEMENTS After discussion, President Kane announced that the next HSAC Executive Committee is tentatively scheduled for 6 Monday, July 10 on Kauai. He requested staff to consult with the members and set a definite date. V. NEW BUSINESS (continued) F. Marine Debris Cleanup Rene Mansho, Community Relations Director for Schnitzer Steel Hawaii Corporation began a briefing of the statewide marine debris cleanup project of the National Oceanic and Atmospheric Administration (NOAA). She stated that NOAA coordinates the collection of drift net and fishing gear debris and ships the debris to Honolulu Harbor. From there, the debris is trucked by Schnitzer (formerly Hawaii Metal Recycling) to its facilities and cut up. The pieces are then transported to H-Power for incineration. Schnitzer engages in the effort as a community service. Before Schnitzer's involvement, the debris was not cut up, could not be incinerated at H-Power, and had to be placed in the Waimanalo Gulch landfill. Ms. Seema Balwani, Management & Program Analyst with NOAA, briefed the Executive Committee on the effort to clean up the drift net and fishing gear debris washed ashore on the main Hawaiian islands. She indicated that an aerial survey has been done and that debris identified during the survey is now being picked up. She indicated that the cleanup of the main islands follows a similar project for the Northwestern Hawaiian Islands. Ms. Balwani's presentation submitted a CD of her presentation. A copy is on file with each county council. VIII. GENERAL MEMBERSHIP MEETING MINUTES The minutes of the June 20, 2006 meeting of the General Membership was approved. III. EXECUTIVE COMMITTEE REPORTS The following Executive Committee reports were approved: A. Report of official action taken at the June 20, 2005 meeting approving the HSAC representatives to the boards of directors of NACo and WIR. OCS/062006/11:01/CT B. Report of official action taken at the June 20, 2005 meeting approving the slate of HSAC officers for fiscal year 2005-06. C. Report of official action taken at the September 9, 2005 meeting approving the HSAC policy amendment authorizing the Hawaii Council to hold the 2006 HSAC annual conference in December 2005 instead of June 2006. D. Report of official action taken at the October 14, 2005 meeting approving the referral of two bills for consideration for inclusion in the 2006 HSAC Legislative Package. E. Report of official action taken at the October 14, 2005 meeting approving the Hawaii Council's request for $1,000 in seed money for the HSAC Year-End Conference scheduled for December 15 and 16, 2005 in Kona. F. Report of official action taken at the December 15, 2005 meeting approving the inclusion of a county liability bill in the 2006 HSAC Legislative Package. G. Report of official action taken at the March 20, 2006 meeting approving the nominations of Honolulu Council Chair Donovan M. Dela Cruz, Maui Council Chair G. Higa and Kauai Councilmember Mel Rapozo to the WIR Board of Directors. IV. UNFINISHED BUSINESS There was no unfinished business. V. NEW BUSINESS A. Policy Amendment The Executive Committee considered the following amendment to the HSAC policy on the annual conference (new material is underscored): 2 "ANNUAL CONFERENCE The corporation shall hold an annual conference each June for the preceding fiscal year. Each county shall host an annual conference once every four years commencing in June 2005 with the County of Kauai. The County of Kauai or the County of Maui shall host conferences in odd- numbered years. The City and County of Honolulu or the County of Hawaii shall host conferences in even-numbered years. Except that the County of Hawaii shall host the 2006 annual conference in December 2005 instead of June 2006." President Kane stated that the policy amendment needed to be approved as a formality. The Executive Committee then approved the amendment. B. Proposed HSAC Budget For Fiscal Year 2006-07 President Kane recommended the following amendments to the proposed HSAC budget for fiscal year 2006-07 set forth in the correspondence, dated April 24, 2006, from him to Executive Committee members: (1) Under "revenues," the "conference income" item should be changed from "$0" to "$1,215"; (2) Relatedly, "total revenues and fund balance" should be increased from "$52,965" to "$54,18011; (3) Under "expenditures," the "NACo dues" item should be increased from "$24,365" to "$25,580"; and (4) Relatedly, "total expenditures should be increased from "$52,965" to "$54,180." The Executive Committee approved the proposed budget with the recommended amendments. VI. ELECTION OF OFFICERS The Executive Committee approved the following slate of HSAC officers for fiscal year 2006-07: 3 1. President Mel Rapozo (Kauai); 2. Vice President Stacy K. Higa (Hawaii); 3. Kane, President Hawaii State Association of Counties 200 South High Street Wailuku, Maui 96793 Dear President Kane: Pursuant to Section 20 of the Bylaws of the Hawaii State Association of Counties (HSAC), which requires a report of every official action taken, the following reports on the approval of the slate of HSAC officers for fiscal year 2006-07. The Executive Committee, based on the unanimous approval of the county councils, has approved the following as, the slate of HSAC officers for fiscal year 2006-07: President Mel Rapozo, Kauai Councilmember Vice President Stacy K. Higa, Hawaii Council Chair Secretary Remy M. Cachola, Honolulu Councilmember Treasurer Joseph Pontanilla, Maui Councilmember Two officers on the current Executive Committee will leave their councils to run for higher offices and a third cannot run for reelection because of term limits. Thus, three of the four officers on the new Executive Committee will be new, including the incoming President. Despite this situation, the present Executive Committee is confident that the new officers will perform well. Kane, President Hawaii State Association of Counties 200 South High Street Wailuku, Maui 96793 Dear President Kane: Pursuant to Section 2Q of the Bylaws of the Hawaii State Association of Counties (HSAC,), which requires a report of every official action taken, the following reports on the approval of a disbursement of $1,000 to the Maui County Council for the opening of a new HSAC checking account. By correspondence, dated June 8, 2006, the, President requested the $1,000 disbursement as seed money to allow the incoming Treasurer, who will be a Maui Councilmember, to open a new HSAC checking account. The President noted that the present checking account limits HSAC to issuing only three checks a month without charge of a service fee. The President indicated that the limit may be too restrictive. With the change of Treasurer in fiscal year 2006-07, the President commented that a change of checking account now would be appropriate. The President also clarified that the old checking account will be closed when the new one is opened. The Executive Committee agreed with the sentiments of the President and approved the requested disbursement. With the passage of Act 346 (codified at Hawaii Revised Statutes (HRS), chapter 613), the Center for Alternative Dispute Resolution (the Center) was established in '1989. HRS chapter 613 states that the Center shall have a Board of Advisors that shall include, among others, two representatives from the Hawaii State Association of Counties (HSAC). Council member JoAnn Yukimura of Kauai County is currently on the Center's Board; the second HSAC slot is vacant. I, therefore, respectfully request that the HSAC appoint a representative to fill the current vacancy. If you have any questions regarding this request or the work of the Center, please contact Ms. Elizabeth Kent, the Center's Director, at 539-4238. Ms. Kent will be happy to assist you. I have also enclosed some materials regarding the Center, as well as information related to mediation and other alternative dispute resolution programs.
