RE: Request for Opinion -Amendment of Agenda; Executive Meeting Agenda, (S INVES-P 06-15)
This is in response to your opinion dated July 19, 2006, which found, in part, that the Council
amendment to its agenda of March 1, 2006, to consider the Hokulia lawsuit was not allowed.
On page 5, OIP notes the following:
"[t]hat Corporation Counsel's request that the Council add the item to its agenda was made on
February 23, 2006, which was six calendar days prior to the March 1 meeting. Given this
timeframe, the Council should have simply filed a new agenda on February 23 that included the
Hokulia lawsuit as an agenda item that the Council anticipated would be considered in executive
session ....The filing of a new agenda would have avoided the requirements for amending the
agenda."
Our records show that Corporation Counsel's letter was dated February 23, 2006, and sent via email
at 4:37 p.m. on February 23, 2006, after the close of business. The letter was date stamped the
following day on February 24, 2006, at 8:05 a.m. [see attachment]
Please let us know if we are incorrectly counting the required days to post notice.
