RESOLUTION REQUESTING THE HAWAII COUNTY COUNCIL TO LOOK INTO
BANNING SMOKING AT KAHALU`U BEACH PARK.
WHEREAS, the West Hawaii Youth Fishery Council is a volunteer organization
comprised of youths from the Kailua-Kona area who aze dedicated to preserve the pristine
offshore and near shore waters off the greater Kailua-Kona area as the habitat for various species
offish and other sea animals; and
WHEREAS, the West Hawaii Youth Fishery Council has conducted reseazch and
compiled the following data in support of this Resolution; and
WHEREAS, the activities of humans on the beach azeas can have an effect on the beach
flora and fauna and the near shore waters; and
WHEREAS, smokers at Kahalu`u Beach have been observed putting out their cigarettes
by either placing or tossing their cigarette butts in the sand at the beach; and
WHEREAS, cigazette butts are made of cellulose acetate and aze slow to degrade, taking
an average of over 7 years and a range of 1.5 to 15 years; and
WHEREAS, cigarette filters contain particulate matter from the smoke components that
the filter captures, which may be toxic and a biohazard to the environment, with chemicals that
aze toxic to species offish, crustaceans, zooplankton, echinoderms, nematodes and flatworms,
and in addition, contain 60 known human cazcinogenic chemical compounds, including arsenic,
formaldehyde, chromium and lead; and
WHEREAS, cigarette smoke is a health hazard to those near to the cigazette smoker, and
cigarette filters in the sand aze toxic and are an annoyance, constituting 20 per cent of litter on
beaches throughout the United States and the World; and
WHEREAS, the West Hawaii Youth Fishery Council wishes to preserve the pristine
nature of the near shore and offshore waters and to prevent the toxic biohazards from polluting
and affecting the beach and the near shore sea life.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that on the request of the West Hawaii Youth Fishery Council, the Hawaii
County Council shall prepare an ordinance prohibiting smoking and prohibiting the disposal of
cigarettes at Kahalu`u Beach Park; and
BE IT FURTHER RESOLVED that the ordinance shall provide that: No person shall
smoke/use any tobacco products at Kahalu`u Beach at any time. The penalty for violation of this
ordinance shall be a one hundred dollar ($100.00) fine; and
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawaii shall
transmit certified copies of this Resolution to the Honorable Harry Kim, Mayor; Patricia
Engelhard, Director, Department of Parks and Recreation; Lincoln Ashida, Corporation Counsel;
Lawrence Mahuna, Chief, Hawaii County Police Department; and the West Hawaii Youth
Fishery Council.
