RESOLUTION NO. 421 U6
A RESOLUTION REQUESTING THE MAYOR TO ENTER INTO NEGOTIATIONS
WITH THE GOVERNOR AND THE BOARD OF LAND AND NATURAL RESOURCES
TO AMEND EXECUTIVE ORDER N0.3665 TO REFLECT A CHANGE IN PUBLIC
PURPOSE FOR STATE LANDS SET ASIDE AT KEALAKEHE FROM A KEALAKEHE
WASTEWATER RECLAMATION FIELD AND NORTH KONA GOLF COURSE TO A
KEALAKEHE WASTEWATER RECLAMATION FIELD AND KONA REGIONAL
PARK.
WHEREAS, the Governor in Executive Order No. 3665 dated July 18, 1995, set aside
certain State lands for the following public purpose:
"FOR KEALAKEHE WASTEWATER RECLAMATION FIELD AND
NORTH KONA GOLF COURSE, to be under the control and management of the
Department of Public Works, County of Hawaii, a political subdivision of the
State of Hawaii, situate at Kealakehe, North Kona, Island of Hawaii, Hawaii, and
identified as follows:
Being a portion of the Government Land of Kealakehe, and being
all of Lot 25 of the Villages of Laiopua, Phase I as shown on File
Plan 2128 filed in the Office of the Bureau of Conveyances of the
State of Hawaii and containing an area of 193.547 acres, more or
less, Subject, However, to Easement 1 for Sanitary Sewer Purposes
affecting Lot 25 as shown on File Plan 2128 and containing an area
of 46,262 square feet, more or less;
Subject, also, to Easement 2 for All Purposes (80.00 feet wide) of
Kealakehe Parkway, Phase I as shown on File Plan 2067 affecting
Lot 25 as shown on File Plan 2128 and containing an azea of
34,052 square feet, more or less...."; and
WHEREAS, a Draft Sewer Master Plan Report for the North Kona Improvement District
Project dated May 2006, prepared for the Department of Environmental Management by SSFM
International, Inc., states the following:
"Per the `Keahole-Kailua Development Plan (1991),' the Kealakehe
Wastewater Treatment Plan is designed for a capacity 2.80 mgd average
flow for the 20-year design and 7.82 mgd average flow for the 40-yeaz
design. However, based on further discussions with the County DEM, the
`as-built' average design flow for the KWWTP is 5.31 mgd.
Per the Wastewater Projections, by the year 2015, the Design Average
Flow from the study area will exceed the current capacity of the KWWTP.
It should also be noted that if the study area were to be hypothetically
sewered, in the current (2005) year the Design Peak Flow (7.91 mgd)
would exceed the existing design capacity of the treatment plant.
Based on the above, it appears that an analysis of the KWWTP capacity
and its expandability is critical and urgent...."; and
WHEREAS, the Kealakehe Wastewater Reclamation Field remains a critical public
purpose for utilization of those State lands set aside in Executive Order No. 3665; and
WHEREAS, the County has diligently attempted to lease portions of the subject lands
for development of a municipal golf course, with only one serious respondent to its Requests for
Proposal who, after paying $10,000,000 to the County of which $6,000,000 was conveyed to the
State under agreement of Executive Order No. 3665, failed to develop a North Kona Golf Course
resulting in years of litigation and final cancellation of the subject contract by the County; and
WHEREAS, subsequent Requests for Proposal have not attracted any respondents; and
WHEREAS, the General Plan describes a "Regional Park" as a Major recreational area
serving several districts and providing indoor and outdoor activities; a major center for spectator
sports and cultural activities; may include features of historic, geological, and horticultural
interests, and has minimum size: 50 acres; and
WHEREAS, development of a Kona Regional Park would provide a wider vaziety of
recreational opportunities to West Hawaii residents than a North Kona Golf Course, and would
serve a broader public purpose for those State lands set aside in Executive Order No. 3665 by
providing open space, park amenities, and a gathering place for future generations of West
Hawaii residents.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that the Mayor is requested to enter into negotiations with the Governor and the
Board of Land and Natural Resources to amend Executive Order No. 3665 setting aside certain
State lands at Kealakehe to be under the control and management of the Department of Public
Works, County of Hawaii, to reflect a change in public purpose from a "Kealakehe Wastewater
Reclamation Field and North Kona Golf Course" to a "Kealakehe Wastewater Reclamation Field
and Kona Regional Park."
BE IT FINALLY RESOLVED that certified copies of this Resolution be sent to the
Honorable Hany Kim, Mayor, County of Hawaii; Bruce McClure, Chief Engineer, Department
of Public Works, County of Hawaii; Peter Young, Chairman, Board of Land and Natural
Resources, State of Hawaii; and the Honorable Linda Lingle, Governor, State of Hawaii.
