Subject: Proposed Resolution No. 381-06, To Postpone Council Action on
Rezoning Applications in the Districts of North and South Kona.
Dear Chair Higa:
The purpose of this resolution is to postpone any action on rezoning applications
occurring in the districts of North or South Kona until the North and South Kona
Community Development Plan is adopted by ordinance. However, the subject resolution
is not clear as to the reason for the "temporary delay" in processing zoning applications
for the subject area. If the intent of the resolution is to stop future development then the
resolution should reflect that reason. Alternatively, if the intent of proposed resolution is
to ensure infrastructure is in place to address future growth then there are ways both local
government and the private sector can address those needs in a positive manner. Stopping
the discussion of projects will in and of itself not resolve any issue.
I strongly recommend the Council consider alternative courses of action when
addressing the issues of growth and or the lack of infrastructure in growth areas.
Establishing moratoriums on growth indicate a failure of government to act responsibly
in addressing public concerns and issues in a timely manner. Using the promise of
updated and or revised community development plans that will be created and adopted
at some future date is also no way to treat property rights of address current community
concerns regarding growth or infrastructure shortfalls.
