RE: Support Of Bill 300 (Alcohol Use In County Parks)
The Department of Parks and Recreation submits this letter in support of Bill 300, which amends Chapter
14 of the Hawaii County Code to allow alcohol by permit only during the hours of 12:00 pm to 10:00 pm
at designated community park facilities. No alcohol would be allowed at any other facilities at any time,
including no alcohol at any county beach parks.
We are in support of the amendment because it will help to:
1. Improve Police enforcement by eliminating the current 4 cumbersome categories which are
inconsistent in times, facilities, and permitting
2. Curtail threats and harassment to Park Patrons, Park employees, Water Safety Officers and Police
officers who must report and respond to public complaints when intoxicated persons become a
public nuisance.
3. Provide a safer work environment for Water Safety Officers who must be able to do their jobs
effectively and efficiently to save lives in the water and on our beaches every day, and are
hampered by intoxicated park patrons.
4. Curtail the public disturbance and desecration of property which coincides with excessive
consumption of alcohol in public parks.
5. Eliminate broken glass and additional rubbish that make parks unsafe and unpleasant for children
and all park users.
6. Reduce public places where people consume alcohol and then drive to other destinations while
intoxicated.
7. Prohibit and prevent under age consumption of alcohol at county facilities to limit public liability
under HRS 663-41, (a), (2), as attached.

[PART V.] CIVIL ACTION; INTOXICATION OF PERSONS
UNDER AGE TWENTY-ONE
[§663-41] Right of action. (a) Any person twenty-one years or older who:
(1) Sells, furnishes, or provides alcoholic beverages to a
person under the age of twenty-one years; or
(2) Owns, occupies, or controls premises on which
alcoholic beverages are consumed by any person under
twenty-one years of age, and who knows of alcohol
consumption by persons under twenty-one years of age on
such premises, and who reasonably could have prohibited or
prevented such alcohol consumption;
shall be liable for all injuries or damages caused by the intoxicated
person under twenty-one years of age.
(b) This section shall not apply to sales licensed under chapter 281.
(c) An intoxicated person under the age of twenty-one years who causes an
injury or damage shall have no right of action under this part. [L 2003, c
