Your Committee on Planning, to which was referred Bill No. 319, reports as follows:
Bill No. 319, transmitted by Council Member Pete Hoffmann via Communication No. 999, dated July 31,
2006, amends Chapter 23 (Subdivision Code), Article 2, Division 1, Section 23-13, Hawaii County Code
1983 (2005 Edition) relating to large scale developments.
Bill No. 319 adds requirements to existing provisions within the Subdivision Code relating to large scale
developments. The new subsections state that conditions of approval for large scale developments should
require that water supply improvements or strategies as specified by the department of water supply to
accommodate the impacts of development, as well as transportation improvements or strategies to
accommodate the impacts of development on state- or county-owned transportation facilities, be made
concurrent with development of large scale subdivisions or condominitun properly regimes nt order to
manage growth and coordinate the delivery of government services in the County.
Bill No. 319 requires developers to ensure that the level of service (LOS) on a state- or county-owned
transportation facility not decline below LOS "D" on a scale of LO5 "A" through LOS "F" unless
transportation strategies to mitigate traffic impacts to an acceptable LOS level ("D" or better) are made
conctnrent with the proposed development. For the purposes of Bill No. 319, "concurrent with development"
means that transportation improvements are either nt place at the time of development or that a financial
commitment is in place at the time of preliminary plat approval to complete the proposed improvements
within a period of six years.
Similarly, Bill No. 319 requires developers to secure a water commitment for full build-out of the proposed
subdivision from the department of water supply and to make required improvements "concurrent" with the
development of the subdivision.
Bill No. 319 also exempts affordable housing projects wherein 100 percent of the units are affordable for
qualified households earning no more than 120 percent of the median adjusted gross income.
Bill No. 318 proposes that similar "concurrency" provisions be added to Chapter 25 (Zoning Code), Hawaii
County Code 1983 (2005 Edition). According to Article 2, Division 4, Section 25-2-43 of Chapter 25,
council-initiated amendments to the Zoning Code must be referred to the "director and the commission with
requests for their respective comments and recommendations thereon, prior to the first reading of any such
amendment. The director and the commission shall each submit comments and recommendations on the
proposed amendment to the council within one hundred and twenty days from the date that the amendment is
transmitted by the council to the director and the commission." Bill No. 319, which amends Chapter 23, is
not subject to this same procedure.

At the August 21, 2006 Committee on Planning meeting, public testimony was received at the Waimea
Council office from Bob Hunter and Mazgazet Willie, both in support of Bill 319 and also Bi11318. At the
Kona Council office Brenda Ford testified in support of Bill 319 and Bill 318.
Your Committee on Planning recommends that Bill No. 319 be referred to the Planning Director and
Planning Commission for their recommendation and comments in accordance with [he procedures set forth in
section 25-3-43, Hawaii County Code.
