Subject: Solid Waste Reduction Project: RFP Monthly Update, September 18, 2006
Enclosed, please find the monthly update of the Solid Waste Reduction RFP, as requested by the
Environmental Management Committee. Attached to the report is the Consultants' response to a
question brought up during their presentation to the Environmental Management Committee
meeting on August 22, 2006.

Monthly Update -September 18, 2006
¦ Solicitation and Contract Document Preparation
R.W. Beck Inc. and Hawkins Delafield & Wood LLP are in the process of
finalizing the Stage 2 RFP and Draft Service Contract based on discussions with
County staff and the Short-listed Proposers.
¦ Presentations and Workshops
The team met with the Council Committee on Environmental Management on
August 22, 2006 regarding the Stage 2 RFP, Project status and to provide
information about Mass Burn Waste-to-Energy technology. Specific goals were
to inform the Committee and the public on the contents of the Solicitation
Documents, the specifics of the technology, and the efforts required after issuance
of the Documents.
The team was also asked to follow-up on the issue of whether the appropriate
amount of due diligence has been performed to date. The team provided a
memorandum to County staff regarding this issue (copy attached).
¦ Project Schedule
Based on discussions with County staff and adjustments that are to be made to the
document, issuance of the Stage 2 RFP is expected in late September or early
October.
The anticipated contract execution date is anticipated to be March-April 2007.
• Action Items and Responsibilities
o R. W. Beck Inc. and Hawkins Delafield & Wood LLP will make the
required adjustments to the Stage 2 RFP and the Draft Service Contract
based on the recent discussions with the stakeholders, and issue the
documents to the Short-listed Proposers.

RE: Background Diligence
At our presentation before the Envirorunental Management Committee on August
22"a a question arose as to whether the appropriate amount of background diligence has been
performed to date on the three companies "shortlisted" by the County to receive the Stage 2
Request for Proposals for the development of the Waste Reduction Facility (the "Stage 2 RFP").
In response to that query, we would like to assure you that the answer in our judgment is
affirmative. This is based upon our experience undertaking well over 100 substantially similar
procurements and particulazly since only three proposals were deemed to have met the minimum
experience requirement, there was no need to expend substantial time and dollazs at that point to
further refine a "shortlist". We are familiar with all three firms as they are performing similaz
services for a combined dozens of municipalities in the United States. While we are comfortable
with our initial assessment, this is certainly not an indication, that further due diligence will not
be required.
As structured, the Stage 2 RFP will request comprehensive proposals from the
shortlisted firms and will set out the evaluation criteria upon which final selection will be based.
As we have previously discussed, qualifications and experience (including legal standing) of
each proposer will be included in the final evaluation, notwithstanding the fact that each of the
proposers has been designated as qualified to receive the Stage 2 RFP. It will be at this stage of
the process, that a more extensive diligence occurs.
In our opinion, it would be an unwise use of County resources and dollars to
perform an exhaustive due diligence examination of a company or companies that may not even
submit proposals to the Stage 2 RFP. It is more appropriate to closely examine the background of
those companies that actually submit proposals as part of the final evaluation and selection
process.
