RESOLUTION NO. 4~~ 13~
RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND MORE THAN ONE FISCAL YEAR FOR AMULTI-YEAR LEASE OF
REAL PROPERTY FOR THE OFFICE OF THE COUNTY CLERK-ELECTIONS
DIVISION.
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease, or
other obligation requiring payment of funds from the appropriations of a later fiscal year and
more than one fiscal year be approved by resolution; and
WHEREAS, the Hawaii County Council finds that uncertainty of the construction
period, and the unknown schedule for phasing each of the eight wings during the capital project
coupled with the perceived risk of asbestos removal warrant a planned move of its employees to
a publicly convenient, environmentally safe and comfortable work place; and
WHEREAS, the Office of the County Clerk-Election Division finds that move to the
Prince Kuhio Plaza has been beneficial to both the public and the division; and
WHEREAS, there are sufficient funds budgeted in the current fiscal year to cover the
anticipated obligations of the County under the lease (license) agreement; and
WHEREAS, HO Retail Properties I, L.P. has agreed not to increase the Lease (License)
rent for another yeaz; and
WHEREAS, the Hawaii County Council wishes to enter into a one (1) year lease
(license) with HO Retail Properties I, L.P. for the 5,000 square feet of office space located at the
111 East Puainako Street, Hilo, Hawaii, 96720, at an approximate cost of $8,594.00 per month,
including General Excise Tax.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII:
1. That the Mayor is hereby authorized to enter into amulti-yeaz lease (license)
agreement for office space for the Hawaii County Council.
2. That sufficient funds be budgeted in future fiscal years to cover the anticipated
obligations of the County under the lease agreement.
BE IT FINALLY RESOLVED that a copy of this resolution be transmitted to the
Department of Finance and the Office of the County Clerk.
