Angel Pilago a Council Member, District 8 RE: Bill 321, Draft 2 -Applicant: Samson LLC (An Ordinance Amending Ordinance No. 95-118, which Amended Ordinance No. 92-36, Hienaloli 4 h and 5 h, North Kona, Hawaii, Tax Map Key: 7-5-10: Portion of 13 (formerly 7-5-23:63)) Attached for your consideration is Bill 321, Draft 2 that sets forth an amendment proposed by Planning Director Chris Yuen at the Committee on Planning meeting held in Kona on September 19, 2006. Bill 321, Draft 2 amends Condition M by adding a provision that the applicant shall implement the approved archaeological mitigation and burial treatment plans. Condition M, as amended, shall read in its entirety, as follows: "M Applicant shall implement the approved archaeological mitigation plan and burial treatment plan Should any remains of historic sites such as rock walls, terraces, platforms marine shell concentrations or human burials be encountered, work in the immediate area shall cease and the Department of Land and Natural Resources - State Historic Preservation Division (DLNR-HPD) shall be immediately notified. Subsequent work shall proceed upon an archaeological clearance from DLNR-HPD when it finds that sufficient mitigation measures have been taken." Your consideration is appreciated.
