SUBJECT: REQUEST FOR PAYMENT OF $143,537 BY DHHL
In trying to settle the DHHL delinquent real property taxes for homestead
lessees, it was brought to my attention that the County of Hawaii supposedly
owes DHHL $143,537, and as a result would like to contra the delinquent
homesteader real property tax bills owing the County.
Unfortunately, there h,as been no approval for the payment of their bill by the
Council. I would like too request that this communication be transmitted to the
proper committee of thie Council for their perusal.
In conclusion, my recommendation is that DHHL be denied payment of
$143,537. The attached letter is self-explanatory and is made part of this
communication.

SUBJECT: DHHL RPT DELINQUENCY
On November 5, 19532, the Council passed Ordinance 92-129 Bill 679, Draft 2,
which allows for the exemption of Real Property taxes on the land of homestead
leases, with only thel minimum tax of $25.00 per year.
On October 6, 1992., a letter was received from Mrs. Drake, then Chair of DHHL,
indicating the commission's commitment to advance funds on its homestead
leases behalf to pay off real property tax delinquencies.
On November 30, 15394, the Council passed Comm. #1427 which provided for
exemption of all penalty and interest due on delinquent DHHL parcels as of
November 30, 1994.
In trying to settle thi;> outstanding delinquency I have been in touch with Kali
Watson, Chairman of the Department of Hawaiian Home Lands, on four different
occasions, two by phone and two by letter.
Apparently the last contact with Kali Watson on 10/14/97, by phone, indicated
that although he agrees to the amount owed to the County, he insists that he
prefers to contra the amount owing by deducting the following:
Keaukaha Flood Control $114,222
Traffic Light-DJlakaala & Kanoelehua 29,315
Total $143,537

The Keaukaha Flood Control is supposedly the County's share of a settlement
which is still pending in court. The traffic light at Makaala and Kanoelehua was
agreed to by Hugh fJno who was the County Engineer at the time.
The DHHL owes the' County of Hawaii:
RPT only as of 11/30/94 $492,716.98
Reimbursement for wood chips
Fire at Kawaihae 11,173.00
Total Owing County of Hawaii $503,889.98
In checking with the Corporation Counsel, I can find no approval for payment of
their Bill.

In conclusion, my re mmendation is that DHHL be denied payme heir
proposed contra of~ 143,537 as it was not part of co ion #1427 which
allowed for exempt eres on the delinquent tax as of
November 30, 1994. In addition, no consideration should be given their request
in lieu of the exempl:ion of penalty and interest.

Pursuant to Section 1(e) of Rule 4 of the Rules of Procedure of the Council of the County
of Hawaii, this written approval is submitted in regard to Communication No.S 5 h ,
from S.K. Schulte, Deputy Finance Director, dated October 24, 1997, relating to the
Department of Hawaiian Home Lands request for payment of $143, 537,waiving said
referral from the Committee on Finance in order that appropriate action can be taken by
the Council.
Should you have any questions, please call Mr. Schute at 961-8201.
In reviewing the contents of the referral, it is deemed advisable that such a waiver be
granted.
