Dear Councilman Santangelo,
When Albert and I applied for a change in zoning for 2 acres adjoining the existing commercial
lot here at Kilauea Lodge, we were approved with the condition that our "fair share"would be to
pay for the proposed four foot wide shoulder fronting the Lodge. (See accompanying letter) The
$8060.00 payment was calculated for afour-foot widening.
Our current problem arose when the road widening was completed and the striping applied. When
Albert and I measured the shoulder (bikeway/footpath) ,the measurements were closer to three
feet instead of the promised four. Albert has withheld our final payment of $2015.00 because
Public Works didn't live up to their agreement. We think we should pay for a three foot shoulder
(as now exists) rather than the four foot (which doesn't exist.)
When we discussed this with Ben Ishii at Public Works, he argues that we should take the $2015
that we owe and widen the extra foot ourselves. The problem with this argument is that the
additional foot would jog into our property and not be contiguous with the whole shoulder
(bikeway/footpath). What purpose would that serve? He admits that the striping was not
accurately measured to reflect the four foot width required for the proposed shoulder. However,
from our most recent conversation (October 22, 199 it did not appear that Public Works was
about to blacken the striping and apply a new stripe, EVEN THOUGH this move would give the
community the four foot shoulder they had been promised (See accompanying notes from
Volcano Community public forum.)
I write this letter in hopes that the controversy will be fairly settled. Albert and I have complied in
GOOD FAITH with the conditions we think are fair. We paid for three feet, not four. Give us the
four foot shoulder, and we'll pay the balance. Give the community the four foot shoulder
(bikeway/footpath) they were promised, and they'll be happy. Everyone will be satisfied. But the
WRONG approach for the County is to ignore the public. The County's error should be rectified
by the County and in a timely manner.

Summaries Of Community Meetings
Volcano
I volcano Cooper Center -May 8, 1997
Members of the Cooper• Center Council, the body responsible for directing activities
at the Cooper Center, constituted most of the twenty-five residents in attendance at
this meeting. Capt. Elroy Osorio of the Hawau County Police Department was also
present at the meeting.
Community and public safety is a priority for area residents. Capt. Osorio
objectively discussed with attendees issues such as increasing ponce presence in
Volcano via a Police substation and expanding their Neighborhood Watch program.
.This brought to light the need for a public phone closer to the Volcano vicinity.
According to residents because of the vandalism and the other illegal activities that
public pay phones attract, many businesses in upper Puna have opted to have them
removed. Only one phone at tiara Store remains. It was agreed that having an
Emergency Call Boa, instead of a public pay phone, is an option for this stretch of
highway.
In keeping with the theme of public safety, residents requested that the Department
of Public Works look into redesigning the narrow bike lane along'the Old Volcano
Highway and the blind tum at the Volcano Traavfer Station. Street lights on Old
Volcano Road and Highway 11 were also suggested. Residents also expressed an
interest in having missing street signs replaced, house numbers synchronized and
drainage ditches along Wright Road cleared. Improvements to and the expansion of '
Parks & Recreational facilities at Cooper Center, particularly a covered play court,
is also a priority for Volcano residents. Other issues brought forward for discussion
included the following:
1. Establishing a Recycling Center at the Volcano Transfer Station
2. Securing a loaner truck for the Volcano Volunteer Fire Station
3. Establishing a Neighborhood Watch

This letter amends our letter dated January 3, 1996 to you regazding your change of Zone
Application (12EZ 95-2). Condition E of Ordinance No. 95 101 states that "In lieu of
constructing 4' wide shoulders, the applicant may contribute a monetary fee in the sum of
$8,060.00 Payment of $8,060.00 will satisfy the shoulder improvement condition
required by the Department of Public Works.
