SUBJECT: BILL 305, IVAN MOCHIDA LAUKAPU STREET REZONING
At the Council Planning Committee meeting on October 18, 2006, a question came up about the
requirement that Dr. Lee-Ching put in sidewalks along the Lanikaula and Laukapu St. frontages
of the property that was granted a use permit for a medical clinic.
This property originally received a use permit in April 1992, with a requirement that sidewalks be
put in along the two roads before a certificate of occupancy for the clinic. Dr. Lee-Ching later
asked for deferral of the condition, and the Planning Commission amended the use permit in
December 1992 to delay the requirement until three years after the certificate of occupancy,
which was issued March 31, 1994. Later, the Planning Commission again amended the
condition, in July 1997, to say that the project could be constructed in two phases, first on
Lanikaula St., within one year, and second on Laukapu St., within two years. No time extension
was allowed for this condition.
It was noted at the Planning Committee meeting that the sidewalks have not been built.
I have no explanation or excuse for that. The Planning Department simply did not follow
up on the requirement. We have sent out a letter to Dr. Lee-Ching reminding him of this
requirement and setting a deadline to hire an engineer and contractor.
