RE: Resolution No. 484-06, Draft 2
For your consideration, I wish to make the following amendment to Resolution No. 484-06 as
follows:
1. Amend the 5th Whereas clause: "...programs and finds it in excess of the needs for which
it was acquired; and."
2. Add as 6`h Whereas clause: "WHEREAS the only separate legal access to Lot I would
be over an unused dead-end section of the former Kailua-Keauhou Middle Road
immediately adjacent to the Kona Vistas Subdivision; and"
3. Add as 7th Whereas clause: "WHEREAS following opening of the Kuakini Highway and
Queen Ka'ahumanu Highway extension this former roadway section was cut off from
sections to the north fell into disrepair, and rendered unsuitable for the public roadway
noses for which it was intended; and"
4. Add as 8th Whereas Clause: "WHEREAS the County has no plans or desire to continue,
encourage or permit use of this portion of the former Kailua-Keauhou Middle Road by
any motorized vehicle; and"
5. Add as 9th Whereas clause: "WHEREAS homeowners of the adjacent Kona Vistas
subdivision have expressed concerns about (1) ongoing illegal activities along this
portion of the old Kailua-Keauhou Middle Road especially near the area fronting Lako
Street (2) additional security and noise impacts to nearby residents caused by any re-
opening of the old roadway to vehicular traffic and (3) view plane and noise impacts to
those residents caused by future commercialization of the subject lot; and"

6. Amend the I Otn Whereas clause: "WHEREAS, the County finds the subject parcel..."
7. Amend the 14cn Whereas clause: "...parcel under Resolution 104-03 (Draft 2), which will
be[is] superseded..."
8. Add new Be it further resolved: "BE IT FURTHER RESOLVED that Resolution 104-03
(Draft 2) is hereby superceded and replaced by this resolution; and"
