RESOLUTION NO. 5 U6 U 6
RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND MORE THAN ONE FISCAL YEAR FOR AMULTI-YEAR LEASE OF
REAL PROPERTY FOR THE OFFICE OF THE COUNTY COUNCIL AND OFFICE OF
THE COUNTY CLERK
WHEREAS, on October 18, 2005, the council adopted Resolution No. 188-05, for the
lease of 6,871 square feet of office space for the council and clerk's staff from BF Hilo Partners
for a period of 12 months; and
WHEREAS, the lease with BF Hilo Partners was executed on June 20, 2006; and
WHEREAS, the Hawaii County Council finds that there is uncertainty as to the time
needed to renovate the Hawaii County Building; and
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease, or
other obligation requiring payment of funds from the appropriations of a later fiscal yeaz and
more than one fiscal yeaz be approved by resolution; and
WHEREAS, there are sufficient funds budgeted in the current fiscal year to cover the
anticipated obligations of the County under the lease agreement; and
WHEREAS, the Hawaii County Council wishes to enter into a Sve (5) yeaz extension
of the lease agreement with BF Hilo Partners for the 6,871 square feet of office space located at
333 Kilauea Avenue, Hilo, Hawaii, 96720 to coincide with the lease agreement dates for the
Legislative Research Branch and the Reprographic Division approved under Resolution No.
460 -06.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII:
1. That the Mayor is hereby authorized to enter into amulti-year lease agreement for
office space for the Hawaii County Council.
2. That sufficient funds be budgeted in future fiscal years to cover the anticipated
obligations of the County under the lease agreement.
BE IT FURTHER RESOLVED that Resolution 188-OS is hereby superseded.
BE IT FINALLY RESOLVED that a copy of this resolution be transmitted to the
Department of Finance and the Office of the County Clerk.
