RESOLUTION NO. 522 U6
RESOLUTION ACCEPTING THE DEDICATION OF LOT 129 IN THE PUALANI ESTATES
SUBDIVISION, PHASE 1, BEING TAX MAP KEY: (3)7-5-041:052, SITUATE AT
PUAPUA`AIKI AND PUAPUA`ANUI, DISTRICT OF NORTH KONA, COUNTY AND
STATE OF HAWAII, FROM D.R. HORTON-SCHULER HOMES, LLC, FOR PARK
PURPOSES.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, D.R. Horton-Schuler Homes, LLC is the owner of Lot 129, area 6.835 acres,
more or less, Pualani Estates Subdivision Phase 1, identified as Tax Map Key: (3)7-5-041:052,
situate at Puapua`aiki and Puapua`anui, in the District of North Kona, County and State of
Hawaii, delineated on Exhibit "A" attached hereto; and
WHEREAS, D.R. Horton-Schuler Homes, LLC is desirous of dedicating the subject
parcel, including all improvements thereon, to the County of Hawai `i for park purposes, in
compliance with Condition J of Ordinance No. 93-76 (Bi1183, Draft 5), and the improvements
have been inspected and approved by the County of Hawaii Department of Public Works,
Planning Department, Department of Water Supply, and the Department of Parks and
Recreation; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the
council may accept gifts, which include the dedication of land on behalf of the County of
Hawaii.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, the
County of Hawaii accepts Lot 129, area 6.835 acres, more or less, of Pualani Estates
Subdivision Phase 1, identified as Tax Map Key: (3)7-5-041:052, including all improvements
thereon, for park purposes.
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Mayor
Harry Kim; (2) the Department of Public Works; (3) The Department of Parks and Recreation;
(4) Assistant Corporation Counsel Gerald Takase; and (5) David M. Lombardi, Case Lombardi
& Pettit, Pacific Guardian Center, Mauka Tower, 737 Bishop Street, Suite 2600, Honolulu,
Hawaii 96813-3283, attorney for D.R. Horton-Schuler Homes, LLC.
