Holschuh, M.D'~B-Q-13C Council Member RE: Bill No. 258, Draft 2/Communication No. 798.7 Proposed Amendments Submission of Bill 258, Draft 3 Based on discussion and decision making during the Council meeting of 10/31/06, I would like to submit Draft 3 of Bill 258, a proposed animal control ordinance to replace Chapter 4, Animals, Hawaii County Code 1983 (2005 Edition, as amended) in its entirety. All proposed amendments that received a favorable vote during said Council meeting have been incorporated into Bill 258, Draft 2 to create Draft 3 of said Bill for Council consideration at Second Reading. Ramseyered text appears in this transmittal communication to indicate any changes to Draft 2 of Bill 258. Article 2. Animal Nuisance 1. Section 4-5. Definitions. "Animal nuisance," for the purposes of this section, shall include but not be limited to any animal, farm animal, or poultry which: (1) Makes noise continuously and/or incessantly for a period of twenty minutes; (2) Barks, whines, howls, crows, cries, or makes any other unreasonable noise as described in section 4-7(b) of this article; or (3) Notwithstanding the provisions of section 142-75, Hawaii Revised Statutes, or any other applicable law, bites, or stings a person. Section 4-8. Complaint forms for private citizens. The animal control contractor, in consultation with the Hawaii County police department, shall develop a complaint form with respect to the keeping of animals, farm animals, or poultry. The form may be obtained by private citizens from the animal control contractor, at the Humane Society Offices, or the office of information and complaints. Article 3. Dog License. 4. Section 4-16. Section 4-49. Agreement between County and animal control contractor required. An agreement containing, but not limited to, the extent of services rendered or to be rendered by the animal control contractor and methods of reporting and accounting shall be entered into between the contractor and the County before any payments may be made to the contractor under this chapter. Any Contract/Agreement shall be reviewed by the Finance Committee and then approved by the Hawaii County Council. FCH/jdh
