Introduction.... I'm speaking for all the homeowners of MG that
are adjacent to the proposed mid-level access road referred to in
Bill #_251
We would like the county council members to know that from our
personal perspective, if this roadway is constructed it would have
very serious economic and health consequences to each and every
home owner MGs especially those who own homes adjacent to
road H.
We would like to know if there is any thought to who will
compensate the abutting home owners for the loss of peace and
quiet as well as monetary loss from heavy equipment vibration and
increased traffic damaging our homes?
In our petition to the Chair and Council Members ( from the home
owners that are presently in the state of HI ) we have outlined a few of the
major health and safety issues we wish you to consider prior to
voting on this matter,
We would like the county council and the Department of Public
Works look into:

1. The grade of the roadway is elevated above and in very close
proximity of the makai side homes (Show photos north side of road),ifthere
was a accident and the vehicle went over the wall there would be
serious property damage as well as a possible personal injury if the
home owner was in their bedroom.
2. Deterioration of a 40 foot rock retaining which is already
showing signs of water failure (show wall photos)
When it rains water flows like little waterfalls between the rocks
(not from the drain pipes)on the lower corner flushing mud from inside the
retaining wall
3. The two homes on the south side of the road Lot #76 & #77
have H road have setbacks that are less that 10 feet. A 15
foot setback is required for the front and rear of a house.(HCC
sec 25-5-7) (any side of a house facing the road and adjacent
to the road considered a front.) If this is true the rough stub
road out will only have a 50 foot right away which is
insufficient for the intended usage of a collector road away

RE: Richard Wheelock letter to the county council dated October 13, 2006 asserting that the mid
level road is safe and wide enough to be dedicated is in my opinion completely erroneous
We believe that the location and the present condition of the
roadway H is dangerous and poses a serious hazard.
For the safety and well being of the MG homeowners we
respectfully request that you do not allow KCE to develop and use
this access road dividing phase 2 from phase 3 of MG, but instead
authorize re-location the roadway mauka and adjacent to MG
on Brian Cooks parcels, and accept the written offer by
