(Res. 467-06) OUT AND FROM THE DESIGNATED FUND ACCOUNT(S) AND
CREDITING SAME TO A DESIGNATED FUND ACCOUNT(S) (transfers
$2,500 from the Clerk-Council Services Contingency Relief Account and credits
same to the Civil Defense Agency to purchase of equipment for the Hawaiian
Pazadise Park Emergency Notification and Evacuation Team)

above resolution. These District 5 Discretionazy funds will be used to purchase
equipment, including two-way radios, bullhorns, emergency vests, flashlights, and
beacons, for the above-mentioned organization.
Comm. 1129: APPOINTMENT OF WILLIAM GILMARTIN TO THE COUNTY OF HAWAII
PUBLIC ACCESS, OPEN SPACE AND NATURAL RESOURCES
PRESERVATION COMMISSION
From Mayor Harry Kim, dated October 10, 2006, submitting for confirmation the
above nomination. Mr. Gilmartin of Council District 6 is a 28-year resident of
Hawaii and was a biologist with the National Marine Fisheries Services from 1980
until his retirement in 1996. He currently volunteers as the Director of Research
for the Hawaii Wildlife Fund, and he is a member of the Northwester Hawaiian
Island Reserve Council and the Hawaiian Monk Seal Recovery Team. He states
that he is not affiliated with any political party. If confirmed, he will serve a term
to expire on December 31, 2011, replacing Mr. John Replogle, whose term will
expire on December 31, 2006.
Comm. 1132: RESOLUTION AUTHORIZING THE ACCEPTANCE OF A MONETARY GIFT
(Res. 491-06) OF EIGHTY THOUSAND TWO HUNDRED SIX DOLLARS ($80,206) FROM
THE DANIEL R. SAYRE MEMORIAL FUND TO THE HAWAII COUNTY
FIRE DEPARTMENT; and
(Bill 350) AN ORDINANCE TO AMEND ORDINANCE NO. 06-79, AS AMENDED, THE
OPERATING BUDGET FOR THE COUNTY OF HAWAII FOR THE FISCAL
YEAR ENDING JUNE 30, 2007 (by appropriating an additional $30,206 to the
Fire Department's Rescue Equipment -Private account)

vehicles and associated equipment that will aid in rescue services around the island.
In the current fiscal yeaz's Operating Budget, $50,000 was already budgeted in the
event that donations, gifts or other contributions were received by the Fire
Department.

Comm. 1134: RESOLUTION AUTHORIZING THE RECEIPT AND EXPENDITURE OF
(Res. 492-06) STATE FUNDING APPROPRIATED BY THE STATE LEGISLATURE
PURSUANT TO ACT 281, SESSION LAWS OF HAWAII 2006, FOR
NON-SCHOOL HOUR PROGRAMS FOR CHILDREN AND YOUTH; and
(Bill 352) AN ORDINANCE TO AMEND ORDINANCE NO. 06-79, AS AMENDED, THE
OPERATING BUDGET FOR THE COUNTY OF HAWAII FOR THE FISCAL
YEAR ENDING JUNE 30, 2007 (by appropriating $52,000 to the County of
Hawaii for non-school hour programs for children and youth)
From Finance Director William Takaba, dated October 10, 2006, transmitting the
above resolution and bill. The State of Hawaii Legislature enacted Act 281,
Session Laws of the Hawaii 2006, which appropriated, in part, $52,000 to the
above program. The Legislature had found that there is widespread agreement
about the importance of establishing safe, structured learning environments for
children and youth during non-school hours as statistics show that rates of juvenile
crime, drug use, and experimentation with tobacco, alcohol and sex increase when
older children are left unsupervised. These funds will be used by the Recreation
Division of the Department of Parks and Recreation for Spring Intercession
programs in communities where 50% or more of the school students are eligible for
free or reduced lunch and for Tour the Island Sport Clinics and camping trips in
each of the five recreational districts: South Hilo, Hamakua/North Hilo/Rural
South Hilo, North/South Kohala, Kona, and Puna/Ka`u.
Comm. 1141: RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER
(Res. 494-06) INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF
DEFENSE, STATE CIVIL DEFENSE, PURSUANT TO HRS 46-7, FOR THE
FY 2006 HOMELAND SECURITY GRANT PROGRAM; and
(Bill 354) AN ORDINANCE TO AMEND ORDINANCE NO. 06-79, AS AMENDED, THE
OPERATING BUDGET FOR THE COUNTY OF HAWAII FOR THE FISCAL
YEAR ENDING JUNE 30, 2007 (by appropriating a $1,138,582 FY 2006
Homeland Security Grant Program [HSGP] for the Hawaii County Civil
Defense Agency)
From Finance Director William Takaba, dated October 16, 2006, transmitting the
above resolution and bill. The State of Hawaii Department of Defense, State Civil
Defense has authorized its FY2006 Homeland Security Grant Program funding of
$1,138,582 for the Hawaii County Civil Defense Agency. These program funds
are to be used for the continued development of three (3) programs: 1) State
Homeland Security Program (SHSP); 2) Law Enforcement Terrorism Prevention
Program (LETPP); and 3) Citizen Corps Program (CCP). The funds, being
provided to prevent, deter, respond to, and recover from threats and incidents of
terrorism, are the result of congressional funding for the purchase of specialized
equipment to enhance the capability of State and County agencies to prevent and
respond to incidents of terrorism but also supports "all hazard" preparedness
initiatives.

Comm. 1142: AN ORDINANCE TO AMEND ORDINANCE NO. 06-79, AS AMENDED, THE
(Bi11355) OPERATING BUDGET FOR THE COUNTY OF HAWAII FOR THE FISCAL
YEAR ENDING JUNE 30, 2007 (by appropriating an additional $8,000 into the
Police Department's Traffic Investigation Program account)
From Finance Director William Takaba, dated October 16, 2006, transmitting the
above bill. The State Department of Transportation Public Affairs -Safe
Community Program is providing additional funding of $8,000. The grant funds
will be used to reduce the number of alcohol related fatalities and injuries, increase
public awareness, and provide a constant deterrence against drunk driving. Under
the current Operating Budget, the initial grant revenues of $12,560 for the Hawaii
County Police Department (HCPD) Traffic Investigation Program account
(3303.32) are inadvertently placed in the Traffic Training and Equipment account
(3303.39). To correct his error, the enclosed bill also decreases the $12,560 from
the Traffic Training and Equipment account and appropriates it to the Traffic
Investigation account.
Comm. 1143: RESOLUTION AUTHORIZING MAYOR TO ENTER INTO AN AGREEMENT
(Res. 495-06) WITH THE STATE'S WIRELESS ENHANCED 911 BOARD FOR
APPROPRIATION AND REIMBURSEMENT OF FUNDS FOR ENHANCED
911 SERVICES FOR WIRELESS COMMUNICATIONS; and
(Bill 356) AN ORDINANCE TO AMEND ORDINANCE NO. 06-79, AS AMENDED, THE
OPERATING BUDGET FOR THE COUNTY OF HAWAII FOR THE FISCAL
YEAR ENDING JUNE 30, 2007 (by appropriating $350,000 for the County's
Wireless E911 system)

above resolution and bill. The funds will be used for the purpose of appropriate
public safety agencies to be provided with a display of a 911 caller's identification
and location when using wireless communications.

Comm. 1145: AN ORDINANCE AUTHORIZING THE ISSUANCE OF GENERAL
(Bi11358) OBLIGATION BONDS OF THE COUNTY OF HAWAII FOR THE PURPOSE
OF FUNDING ALL OR A PORTION OF THE COSTS OF VARIOUS
IMPROVEMENT PROJECTS AND REFUNDING CERTAIN OUTSTANDING
DEBT OBLIGATIONS OF THE COUNTY; FIXING THE FORM,
DENOMINATIONS, AND CERTAIN OTHER DETAILS OF SUCH BONDS
AND PROVIDING FOR THEIR SALE TO THE PUBLIC; AND AUTHORIZING
THE TAKING OF OTHER ACTIONS RELATING TO THE ISSUANCE AND
SALE OF THE BONDS AND THE RETIREMENT OF THE OBLIGATIONS TO
BE REFUNDED (authorizes the issuance of up to $75 million in General
Obligation Bonds for the County of Hawaii; and of an amount not to exceed
$55 million for the purpose of refunding outstanding bonds that were issued at
higher interest rate)

above bill. The County currently has four large projects, the West Hawaii Civic
Center, County Building Repairs, Laiopua Connector Road, and ADA compliance,
which require funding in the next three months (attached Exhibit "A" explaining
each project in detail). The Administration also lists several existing projects
which have used half of 2006A Bond Issuance. As the remaining 2006A Bond
Issue has been allotted for other projects, funds are intended to be used for these
continuing projects as well.

Comm. 1120 RESOLUTION AUTHORIZING THE SALE OF TAX MAP KEY: (3)7-6-013:017
(Res. 484-06): AS A REMNANT PARCEL (between Kailua-Keauhou Road and Kailua-Keauhou
Middle Road at Holualoa, formerly intended for use by the Hawaii County
Fire Department)
From Finance Committee Chair Virginia Isbell, dated October 3, 2006, transmitting
the above resolution. In 1973, the County constructed a new Kailua Fire Station on
Palani Road and no longer has plans to utilize the parcel (TMK: (3)7-6-013:017).

five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawaii County Code}. A lobbyist
means "any individual engaged for pay or other consideration who spends more than five hours in any
month or $275 in any six-month period for the purpose of attempting to influence legislative or
administrative action by communicating or urging others to communicate with public officials."
