Dear Chairman Higa and Council Members:
Re: Bill for an Ordinance Amending Chapter 14, Article 4, of the Hawai'i
County Code, Relating to Smoking in Certain Places (Prohibiting
Smoking at Kahalu'u Beach Park)
On August 1, 2006, the Hawai'i County Council adopted Resolution 407-06,
that on the request of the West Hawai'i Youth Fishery Council, the County Council
is to prepare an ordinance prohibiting smoking and the use of tobacco products at
Kahalu'u Beach Park, prohibiting the disposal of cigarettes, and including a
penalty of one hundred dollars ($100) for any violation.
I am submitting this bill at the request of Councilperson Virginia Isbell. The
bill includes:
1) Definitions for "cigarette" and "tobacco products"
2) Adding Kahalu'u Beach Park as an open area and facility where
smoking of cigarettes or tobacco products, or the use of any tobacco
product, is prohibited
3) A $100 fine for a violation occurring at Kahalu'u Beach Park
(versus a violation at any other site is a $25-50 fine)
Although specified in Resolution 407-06, this bill does not prohibit disposal
of cigarettes at Kahalu'u Beach Park because Hawai'i County Code Chapter 20,

Article 1, Sections 20-2(a), Littering Prohibited, already prohibits the throwing of
litter, including cigarettes, at a public park.
