Higa, Chairman and -a Members of the Hawai'i County Council " 3 rT Hawai'i County Council t 25 Aupuni Street v Hilo, Hawai'i 96720 Re: Resolution for multi-year agreement(s) The County's Office of Housing and Community Development (OHCD) published a public notice on September 17, September 24, and October 1, 2006, in the local newspapers informing property owners that it would be accepting proposals for the Section 8 Project Based Certificate Program (Program). Under the program, the OHCD attaches a Section 8 Housing Assistance Payment Contract (Agreement) to an existing structure or to a structure if the owner agrees to rehabilitate or construct the structure with funding other than with assistance provided under the United States Housing Act of 1937. Through the Program, the rent for each unit in the selected structure(s) will be subsidized by the OHCD when the owner leases the unit to an income eligible family. The purpose of this program is to encourage property owners to make available rental housing unit(s) to low income families at rents within the current housing fair market rents. Enclosed is a resolution authorizing the Mayor to enter into a ten (10) year Housing Assistance Payment Agreement with the Property Owner of the housing project(s) that may be selected for participation in the Section 8 Project Based Certificate Program. To expedite the processing of the Agreement and to ensure that the OHCD meets all processing deadlines as set forth by the United States Department of Housing and Urban Development regulations, the OHCD request a waiver from the Finance Committee and have this resolution heard at Council meeting scheduled for November 29, 2006. REQUEST: The Office of Housing and Community Development (OHCD) respectfully request the approval of a Resolution authorizing the Mayor to enter into a multi-year Housing Assistance Payment Agreement (Agreement) with the Property Owner of the housing project(s) that may be selected for participation in the Section 8 Project Based Certificate Program. To expedite processing of the Agreement and to ensure that the OHCD meets all processing deadlines as set forth by the United States Department of Housing and Urband Development regulations, the OHCD is requesting that the Mayor be given the authorization to enter into a ten (10) year Agreement with property owners selected projects for the Program. The OHCD expects to complete its review of the proposals submitted by property owners to the OHCD in mid-December 2006. As time is of the essence, a request has been made to waive this item from Finance Committee, and send it to full Council meeting scheduled for November 29, 2006. B. The OHCD estimates that up to forty (40) units in the County of Hawaii will be assisted under the funding available for this purpose. The deadline for property owners to submit their proposal to the OHCD was November 1, 2006. Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of Hawaii, this written request is submitted with my approval that the above-referenced matter be waived from the Finance Committee to the full council for immediate action. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter placed onto the next Council agenda for review. However, in the event this request is denied, for whatever reason, I understand the matter shall be referred to the Finance Committee for placement on its future agenda.
