Your Committee on Public Safety and Parks and Recreation, to which was referred
Communication No. 798, and attached Bill No. 258, which replaces Chapter 4, of the Hawai`i
County Code relating to animals, in its entirety, reports as follows:
Communications No. 798, transmitted by Councilmember James Arakaki, dated March 29, 2006,
proposes to replace Chapter 4 HCC, with Chapter 7, Animals and Fowl, of the Revised
Ordinances of Honolulu. Wording in Bill No. 258 is adapted to reflect the different jurisdiction.
Bill No. 258 contains provisions relating to the following: cockfighting and related equipment,
animal nuisances, dog licenses, regulation of dogs, public spay and neuter clinic for dogs and
cats, cat identification program, and regulation of dangerous dogs. It also includes provisions
regarding licensed obedience trial, tracking and show dogs, sterilization of cats and dogs, and
regulation of strays and noisy animals.
Committee members expressed concern that Bill No. 258 would need amending to ensure it
reflected the difference in the urban setting on Oahu and the mostly rural setting on Hawai`i
Island. Also, Bill No. 258 provided for fines to be directed to the county's general fund; and it
was pointed out that previous determination had been made that only fees could be retained by
the county, while fines are to be directed to the state.
It was the consensus of Your Committee that Bill No. 258 be on the Council agenda after enough
time for representatives from the Humane Society and from Corporation Counsel to review it and
recommend appropriate amendments.
Your Committee on Public Safety and Parks and Recreation is in accord with the purpose and
intent of Bill No. 258 recommends it pass first reading.
