No. 1101Bi11 No. 344 PLACE: Councilroom (new location) Ben Franklin Building 333 Kilauea Avenue, 2"" Floor Hilo, Hawaii TIME: 2:00 p.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 344, reports as follows: Bill No. 344, transmitted via Communication No. ] 104 from Mayor Harry Kim, dated September 27, 2006, presents a Change of Zone Request by Jon Mitsuda at Waiakea, South Hilo, Hawaii, TMK: 2-4- 80:15 (formerly 2-4-3: portion of 4). Bill No. 344 seeks to repeal Ordinance No. 96-81 which amended Section 25-114 (City of Hilo Zone Map), Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the District Classification from Agricultural (A-3a) to Single Family Residential (RS-10) at Waiakea, South Hilo, Hawaii, covered by Tax Map Key: 2-4-80:15 (formerly 2-4-3: portion of 4). Communication No. 1101 reports that the Hawaii County Planning Commission, as required by Chapter 4, Sec. 6-4.3(C), Hawaii County Charter, considered the above request on September 7, 2006. The Commission voted to send a favorable recommendation to the County Council regarding applicant's request to repeal Ordinance No. 96-81 that reclassified approximately 1.952 acres of an approximately 7.871-acre property from Agricultural 3-acre (A-3a) to a Single Family Residential - 10,000 square feet (RS-10) district. Communication No. 1101 transmits the following findings and recommendations: l . The subject property is located at the west end of Ahe Street, adjacent to the Hoomalu Street Subdivision, Waiakea, South Hilo, Hawaii. 2. Applicant has submitted a request to repeal Ordinance No. 96-81, which reclassified approximately 1.952 acres of an approximately 7.871-acre property from A-3a to RS-10. The prior owner obtained the RS-10 Change of Zone for approximately 1.952 acres to allow subdividing that 1.952-acre portion into six 10,000 square foot lots, but subsequently decided not to proceed with the 6-lot subdivision. 3. The applicant purchased the two-lot subdivision on August 5, 2004 and has no intention of subdividing the RS-] 0 zoned portion of the property and is requesting a repeal of Ordinance No. 96-81 that will result with reversion of the RS-10-zoned area to its original Agricultural 3-acre (A-3a) district. At the October 30, 2006 meeting, no public testimony was presented on this matter. By fax dated October 27, 2006, Applicant Mr. Mitsuda notified the Committee that he is unable to attend today's PC Report No. 123 Communication 1101 Bill 344 Page 2 of 2 meeting due to safety projects at his employment that required his attention and asked that the Planning Committee grant his request to repeal Ordinance No. 96-81. Planning Director Chris Yuen stated that the reason Ordinance No. 96-81 is being repealed is that the applicant did not want to construct the 10,000 sq. ft. (6-lot subdivision). Your Committee concurs with the Planning Commission and the Planning Director's favorable recommendation for the repeal of Ordinance No. 96-81 as requested by the applicant.
