Your Committee on Planning, to which was referred Resolution No. 517, reports as follows:
Resolution No. 517, transmitted via Communication No. 1174 from Christopher J. Yuen, Planning
Director, dated October 31, 2006, transmitting the proposed Resolution for approval of in lieu fair shaze
contribution as required by Condition "N" of Change of Zone Ordinance No. 02-95 regazding Bart T.
Cahoon Trust, for property located at Kalaoa, North Kona, Hawaii, TMK: (3) 7-3-5: 97.
Resolution No. 517 requests Council consideration and approval of in lieu fair share contribution in an
amount of $26,500.00 for support of road and traffic improvements, as required by Condition "TI" of the
above referenced Ordinance No. 02-95.
Communication No. 1174 states that Condition "N" requires landowner to comply with the requirements
of Fair Share Contribution to mitigate potential regional impacts of the project and that Condition "N 5."
require payment of fair shaze contribution to support road and traffic improvements and that the fair
market value of land contributed in lieu of the fair share contribution shall be subject to review and
approval by the Planning Director.
Condition "H" of Ordinance No. 02-95 requires that the landowner dedicate its interest in the `Ili `Ili
Street roadway (Tax Map Key: (3) 7-3-5: 102) fronting the property to the County of Hawaii. On
December 7, 2005 the County Council adopted Resolution No.179-OS authorizing acquisition of
landowner's interest in said roadway by eminent domain for a connector road between the Kona Palisades
and the Kona Coastview Subdivisions.
The landowner submitted a fair mazket value of the land, which was condemned by the County, in the
amount of $26,500.00 to offset the full amount of the fair share contribution requirement, which fair
market value has been reviewed and approved by the Planning Director.
At the November 14, 2006 Planning Committee meeting, no one appeared from the public to present
testimony on this matter.
Planning Director Yuen gave a brief background presentation and noted that this kind of request is one
that the Director states should qualify as a credit. This is a road that connects two areas in Kalaoa and so
the fair market value of the land for the road will be dedicated to the county and provide cross-
connection. The value of $26,500.00 offsets road fair share for seven (7) lots of a IS-lot subdivision. Mr.
Yuen noted that the amount being credited is enough to cover the seven lots.
