Your Committee on Planning, to which was referred Resolution No. 518, reports as follows:
Resolution No. 518, transmitted via Communication No. 1175 from Christopher J. Yuen, Planning
Director, dated October 31, 2006, transmitting the proposed Resolution for approval of in lieu fair shaze
contribution to satisfy Condition "H" of Change of Zone Ordinance No. 97-91 regarding Douglas and
Joseph DePonte, for property located at Waiakea, South Hilo, Hawaii, TMK: (3) 2-4-65:4.
Resolution No. 518 requests Council consideration and approval of in lieu fair share contribution in an
amount of $144,080.08 for the support of road and traffic improvements, as required by Condition "H" of
the above referenced Ordinance No. 97-91.
Condition "H.4" of Change of Zone Ordinance No. 97-91 requires payment of fair share contribution to
support road and traffic improvements.
Condition "E" requires that the landowner subdivide and dedicate to the County of Hawaii the 40-foot
future road widening setback section and the 30-foot radius section along Kupulau Road fronting
landowner's property. The landowner submitted a fair market value of the land, to be contributed to the
County, of $144,080.08 to offset the full amount of the fair shaze contribution requirement for road and
traffic improvements. The Planning Director has reviewed and approved the fair market value of the land
of $144,080.08.
At the November 14, 2006 Planning Committee meeting, no one appeazed from the public to present
testimony on this matter.
Planning Director Yuen presented a brief background report stating that the developer needs something
like $48,000 to cover the 14 lots and again, the excess credit simply goes away.
