Your Committee on Planning, to which was referred Resolution No. 519, reports as follows:
Resolution No. 519, transmitted via Communication No. 1176 from Christopher J. Yuen, Planning
Director, dated October 31, 2006, transmitting the proposed Resolution for approval of in lieu fair shaze
contribution to satisfy Condition "L" of Change of Zone Ordinance No. 98-36 regarding Hanaula Village
Partners, LLC, for property located at Hanaula, North Kohala, TMK: (3) 5-4-6:21 and 36.
Resolution No. 519 requests Council consideration and approval of in lieu fair shaze contribution in an
amount of $131,590.54 for the support of park and recreational improvements and facilities, as required
by Condition "L" of the above referenced Ordinance No. 98-36.
Condition "L 1." of Change of Zone Ordinance No. 98-36 requires payment of the fair shaze contribution
to support park and recreational improvements and facilities and, Condition "L" of Change of Zone
Ordinance No. 98-36 states that in lieu of paying the fair share contribution, the landowner may construct
and contribute improvemenUfacilities related to parks and recreation.
To satisfy Condition "L 1."of Change of Zone Ordinance No. 98-36, Hanaula Village Partners offers to
provide actual pazk and recreation improvements and facilities in the amount of $131,590.54 at
Kamehameha Park in North Kohala, Hawaii. The County Department of Pazks and Recreation supports
the proposal and believes that the value of any recreational project is needed to benefit the community.
The Planning Director has reviewed and approves the proposal to provide actual pazk and recreation
improvements and facilities in the amount of $131,590.54 to satisfy the in lieu fair share contribution.
At the November 14, 2006 Planning Committee meeting, no one appeared from the public to present
testimony on this matter.
Committee Vice Chair Hoffmann stated his understanding that this resolution increases the amount he and
the developer has been working with, which was $118,000.00. Director Yuen stated he could not explain
the difference between the two amounts, however, he noted that there is a clause in the fair share
provision that talks about adjustments for increase in the consumer price index. Mr. Yuen stated that it
gets a little complicated in calculating adjustment because of different start dates for different ordinances
and that in this case, due to inflation, the amount was adjusted upwards.
